Operative words
NOW, THEREFORE, UNDER THE AUTHORITY OF TEXAS GOVERNMENT CODE SECTION 418.108, I, JANE HUGHSON, MAYOR OF SAN MARCOS HEREBY STRONGLY RECOMMEND AS FOLLOWS: SECTION 1. WEAR A FACE COVERING. Every person in San Marcos, whether resident or visitor, shall wear a face covering over the nose and mouth when inside a commercial entity or other building or space open to the public, or when in an outdoor public space, wherever it is not feasible to maintain six feet of social distancing from another person not in the same household... [Recital:] failure to comply with any Executive Order issued during the COVID-19 disaster is an offense punishable by fine under Section 418.173 of the Texas Government Code and local governments are authorized to enforce any Executive Order.
