Operative words

The court has received appellants' emergency motion for injunction pending appeal. The response to the motion is due at 9:00 a.m. Pacific Time on December 28, 2020. The optional reply in support of the motion is due at 9:00 a.m. Pacific Time on December 29, 2020. [O'Scannlain, J., concurring in part and dissenting in part:] I strongly object to our failure to accommodate, even in a temporary fashion, Harvest Rock Church's request for relief from California's severe restrictions on indoor worship services by December 24.... Harvest Rock Church's claims against California's restrictions appear strong.

Correction (repair, Sept. 27, 2026): this exhibit is the Ninth Circuit's Dec. 23, 2020 order setting a briefing schedule on the emergency motion and declining to grant temporary relief before Christmas, over Judge O'Scannlain's partial dissent; it is not a merits denial of the injunction pending appeal. The panel's later denial, 985 F.3d 771 (9th Cir. 2021), is recited in Ex. SEC-16-035 (Bumatay, J., dissenting) and is not in this folder.
