Operative words

In order to reopen your business, please complete and sign the following checklist once you have completed your COVID-19 Control Plan template.... Be assured we have taken the following steps to comply with state mandatory safety standards for workplaces: Workers are wearing face coverings and we've put social distancing measures in place

Penalty

Order No. 33 s. 3 self-certification requirement; $300 civil fine per violation and injunction under Orders No. 33 and 37; complaints to the Attorney General's Fair Labor Division

What it required

Before reopening, each business completed a COVID-19 Control Plan and signed the attestation that it had complied with the four categories of mandatory standards (face coverings and social distancing; hand washing and sanitizing of high-touch areas; staff training on distancing and hygiene; cleaning and disinfecting protocols) and displayed it to employees and visitors; the Attorney General's release of May 20, 2020 states the display as a duty ('employers must post a completed compliance attestation poster') and lists 'Failure to Display Compliance Attestation Poster' as a reportable violation (DUT-MA-003).

Retrieval note

The poster's own verb for display is 'should be displayed'; the Attorney General's contemporaneous statement is 'must post' (DUT-MA-003); Order No. 33 s. 3 (Ex. MA-017, enforcement field: 'self-certification and posted attestation required before opening') is the instrument that imposed the duty.
