Operative words
The 2017 Food Code and the accompanying 2017 Food Code Supplement, not including subsequent amendments and editions, established by the U.S. Department of Health and Human Services, Food and Drug Administration (hereinafter referred to as the "Food Code") are hereby incorporated by reference.

What it required
Every permitted food establishment must operate in compliance with the FDA Food Code as North Carolina's sanitation rule, including its employee-health provisions on reporting, exclusion and restriction of ill food employees and its hygiene, cleaning and sanitizing requirements, as a condition of the permit required by G.S. 130A-248(b) (Ex. DUT-NC-011).
