Operative words

2. Employers shall permit employees to establish and administer a joint labor-management workplace safety committee, but not more than one committee per worksite

Penalty

Enforced by the Commissioner of Labor under the Labor Law's general enforcement provisions; anti-retaliation protections in the section

What it required

Every private employer of at least ten employees to permit a joint labor-management workplace safety committee authorized to raise health and safety concerns and review the employer's policies, the second limb of the HERO Act; recorded here because its effective date (November 1, 2021) falls after the sixth quarter, so it is not pleaded as a duty in force in any of the six quarters.

Retrieval note

Honesty rule applied: in_force_quarters is empty because the section took effect November 1, 2021 ('section two of this act shall take effect on the one hundred eightieth day after it shall have become a law,' ch. 105, § 3, Ex. NY-082, as amended by ch. 142, Ex. DUT-NY-015). It evidences the Legislature's continuing regime, not a duty operative in the six quarters.
