Philadelphia ran the most continuous local regime in Pennsylvania and one of the longest in the country: the City issued penalty-backed emergency orders and Board of Health regulations without interruption from March 12, 2020 through the end of the third quarter of 2021 and beyond. The run-up to the second quarter of 2020 began with the Health Commissioner's March 12, 2020 order prohibiting gatherings of 1,000 or more (Ex. MET-PHL-001), the Mayor's and Commissioner's March 17, 2020 Order No. 1 closing every non-essential place of business at 5:00 p.m. on March 16 and prohibiting office-based businesses from operating with personnel in the office (Ex. MET-PHL-002), and Order No. 2 of March 22, 2020, effective 8:00 a.m. March 23 'indefinitely', which closed non-essential businesses, confined businesses required to suspend physical operations to 'essential on-site personnel to maintain critical functions', prohibited 'all public and private gatherings of any number of people occurring outside a single household', and ordered that 'All Philadelphia residents shall remain home' except for enumerated Essential Personal Activities (Ex. MET-PHL-003). The Board of Health adopted Order No. 2 as an emergency regulation on March 26, 2020 (effective March 27) and on April 29, 2020 adopted the fines regulation (up to $2,000 per violation for businesses and $500 for individuals) that every later order incorporates (Ex. MET-PHL-070). Construction in the City was prohibited by Order No. 2 until the April 29, 2020 Construction Authorization allowed permitted projects to resume at 7:00 a.m. on May 1, 2020 under worker-density caps and a Site Safety Manager requirement (Ex. MET-PHL-023), expanded May 15 and May 26, 2020 (Exs. MET-PHL-024, 025). The Governor's March 23, 2020 stay-at-home order for Philadelphia, Bucks, Chester, Delaware and Montgomery Counties and his March 19, 2020 closure orders ran in parallel (State instruments). The First Judicial District closed every court and related office from March 17, 2020 (Ex. MET-PHL-048), declared a judicial emergency the same day (Ex. MET-PHL-050), stayed residential writs of possession from March 16 (Ex. MET-PHL-049), and by its amended Order 33 of 2020 suspended all civil and criminal jury trials through September 8, 2020 and cancelled every in-person trial, hearing and conference through July 6, 2020 (Ex. MET-PHL-052). Bucks County's Court of Common Pleas suspended all trials, postponed April sheriff sales and suspended writs of possession by Emergency Order 2020-01 (Ex. MET-PHL-047); Delaware County's 32nd Judicial District declared a judicial emergency that its President Judge extended six times into 2021 (Ex. MET-PHL-075) and set aside only on August 12, 2021. SEPTA cut to a 'Lifeline Service Schedule' on April 9, 2020 with closed stations and police controlling access for essential travel (Ex. MET-PHL-040) and required face coverings of every rider from June 8, 2020 (Ex. MET-PHL-041); PATCO ran a modified schedule with four stations closed from March 28, 2020 (Ex. MET-PHL-082). Across the river, Camden County's Freeholder Director proclaimed a local emergency on March 14, 2020 (Ex. MET-PHL-079), sent every nonessential county employee home and closed county libraries, schools and agencies from March 16 (Ex. MET-PHL-066), banned playgrounds and self-service food and beverage in convenience and grocery stores on March 18 (Ex. MET-PHL-067), and extended the closure of county offices indefinitely on March 28, 2020 (Ex. MET-PHL-068); Governor Murphy's Executive Order No. 108 of March 21, 2020 then invalidated every county and municipal COVID-19 restriction that conflicted with Executive Order No. 107 and barred new ones, so that from 9:00 p.m. on March 21, 2020 the operative business restrictions in Camden County were the State's. Philadelphia moved to the Yellow Phase on June 5, 2020 by an order that suspended the stay-at-home directive but required businesses that had operated remotely to 'continue to conduct such operations remotely', imposed universal masking of employees and customers, employer reporting of positive cases, four-hourly disinfection and an office density cap of 5 persons per 1,000 square feet (Ex. MET-PHL-005); the City then withheld indoor dining, gyms and theaters after the suburban counties entered the Commonwealth's Green Phase on June 26, 2020, adopting a 'Modified Green Phase' on July 3 with indoor gatherings capped at 25 and outdoor at 50 (Ex. MET-PHL-007), reopening gyms July 20 (Ex. MET-PHL-029) and indoor dining only on September 8, 2020 at 25 percent of fire-code occupancy (Ex. MET-PHL-008), raised to 50 percent for certified establishments on October 2 (Ex. MET-PHL-033). The June 26, 2020 face-covering order (Ex. MET-PHL-006) never lapsed. The fall re-tightening came by the Fall/Winter Order of November 16, 2020, effective 5:00 p.m. November 20: indoor dining, gyms, museums, libraries and theaters closed, all indoor gatherings across households prohibited, high schools and colleges moved online, office work 'must generally continue to be conducted remotely' at 5 persons per 1,000 square feet, and the owner of every business made liable for occupants' non-compliance (Ex. MET-PHL-010), extended to January 15, 2021 with a rewritten telework mandate ('Reduced efficiency... does not constitute impossibility') (Ex. MET-PHL-011). The Restated and Consolidated Order of January 15, 2021 (Ex. MET-PHL-012) and the Spring 2021 Order of February 27, 2021 with its amendments (Exs. MET-PHL-013, 014, 015, 063) carried mandatory telework, office density of 2 persons per 1,000 square feet, indoor dining at 25 percent with parties of four, a bar-service prohibition, and masks regardless of vaccination status through May 20, 2021; the Further Reopening Order of May 20 kept masks and the sector rules to June 10, 2021 (Exs. MET-PHL-016, 017). Montgomery County's Board of Health ordered every public and private K-12 school in the county to virtual instruction from November 23 to December 6, 2020. General business restrictions in the City ended at 11:59 p.m. on June 10, 2021 by the Full Reopening Order (Ex. MET-PHL-018), but that order, which the Board of Health adopted as the Second Consolidated and Restated Supplemental Emergency Regulation effective July 16, 2021 (recited in Ex. MET-PHL-020), remained in force for the whole of the third quarter of 2021 and bound 'All businesses that are operating within the City of Philadelphia' to masks regardless of vaccination status at healthcare institutions, congregate facilities, schools and child care and on public transportation, to a contact-tracing duty, to mandatory isolation of infected workers and quarantine of unvaccinated close contacts, to owner liability and to inspection 'as a condition of operation'. The Delta wave brought the August 11, 2021 amendment, effective 12:01 a.m. August 12, requiring masks in 'Any indoor setting' regardless of vaccination status unless the business verified the vaccination of everyone present, and at outdoor events of 1,000 or more (Ex. MET-PHL-019), which the Board of Health adopted on August 13 while denying grocery stores, pharmacies and doctors' offices the vaccinated-only exception (Ex. MET-PHL-020); the Board's Emergency Regulation Mandating Vaccines for Healthcare Workers and in Higher Education, adopted August 12 and effective August 16, 2021, which bound every 'Healthcare Institution' that 'employs, coordinates, or otherwise engages the services of Covered Healthcare Personnel in the City' to documentation, exemption, testing and inspection duties at once and to an employment bar from October 15, 2021 (Ex. MET-PHL-021), construed by the Department's Health Alert of August 25, 2021 to reach home health agencies and aides (Ex. MET-PHL-022); and the City's September 14, 2021 notice requiring every contractor, vendor and service provider to certify staff vaccination status, keep proof on file and double-mask unvaccinated staff, on pain of breach of contract (Ex. MET-PHL-065). The First Judicial District's residential eviction moratorium ran through October 3, 2021 (Ex. MET-PHL-060), its stay of Sheriff's mortgage-foreclosure and tax sales ran to September 2021 (Ex. MET-PHL-056), and on September 24, 2021 its Administrative Governing Board entered a further Judicial Emergency order (Ex. MET-PHL-059). Montgomery County required masks in all county buildings from August 16, 2021; Bucks County's Health Department issued only advisory school guidance on August 15, 2021 (Ex. MET-PHL-080); Delaware County passed from the Chester County Health Department's jurisdiction to the Pennsylvania Department of Health on August 1, 2021 (Ex. MET-PHL-045). Pennsylvania never barred local orders: the General Assembly's H.R. 106 (June 10, 2021) ended the Governor's disaster emergency and left Philadelphia's Board of Health regime untouched. New Jersey did bar them, by Executive Order No. 108 from March 21, 2020, so that Camden County's regime after that date is the State's, cited by name and date.

What remained in force

In the City through September 30, 2021 and beyond: the Full Reopening Order and the Board's Second Consolidated and Restated Supplemental Emergency Regulation (July 16, 2021): masks regardless of vaccination status at healthcare institutions, congregate facilities, schools, camps and child care and on all public transportation; a business duty to identify close contacts and report them to the Department on request; a business duty to keep infected workers and unvaccinated close contacts out of any in-person workplace during isolation and quarantine; owner liability for occupants' non-compliance; inspection as a condition of operation; the April 29, 2020 fines regulation; the Health Commissioner's separate Mandatory Data Reporting Orders and the Long-Term Care Isolation Safety and Transfer regulation. From August 12, 2021: masks in any indoor setting and at large outdoor events. From August 16, 2021: the healthcare-worker and higher-education vaccination regulation. From September 1, 2021: City employees vaccinated or double-masked (City release). From September 14, 2021: contractor and vendor staff vaccination-list, proof and double-masking requirements. Courts: the First Judicial District's eviction moratorium through October 3, 2021 and its sheriff-sale stay to September 2021; the Judicial Emergency order of September 24, 2021. Transit: the federal conveyance mask order and TSA directives as implemented by SEPTA and PATCO, and the City's own transit-mask clause.

The State and the local orders

Pennsylvania: no statute or executive order barred local COVID-19 orders at any time in the period. Philadelphia acted under its own home-rule health powers (Philadelphia Home Rule Charter section 8-407; Philadelphia Code sections 6-205 and 6-206; the Disease Prevention and Control Law of 1955, 35 P.S. section 521.1 et seq.), and the four suburban counties acted under the Emergency Management Services Code (35 Pa.C.S. section 7501) and, for Montgomery, Bucks and Chester Counties, their county health departments' authority under the Local Health Administration Law and the Disease Prevention and Control Law (Delaware County had no health department until April 2, 2022 and was served by the Chester County Health Department under an intergovernmental agreement from March 18, 2020 through July 31, 2021, then by the Pennsylvania Department of Health). The General Assembly's H.R. 106 (June 10, 2021) terminated the Governor's disaster-emergency proclamation and Act 21 of 2021 (Act of June 11, 2021, P.L. 56, No. 21) continued regulatory suspensions to September 30, 2021; neither instrument touched Philadelphia's orders and regulations, which continued unbroken. The Montgomery County Board of Health's November 13, 2020 school order survived a parents' motion for an injunction in the Court of Common Pleas (press report). New Jersey: Governor Murphy's Executive Order No. 108 (March 21, 2020, effective 9:00 p.m. that day) 'invalidated' every 'county or municipal restriction imposed in response to COVID-19 that in any way will or might conflict with any of the provisions of Executive Order No. 107 (2020), or which will or might in any way interfere with or impede its achievement', listing as examples 'Any additions to or deletions from the list of retail businesses that I have deemed essential', 'Any limitations imposed on any business's scope of service or hours of operation', 'Any density or social distancing requirements', 'Any orders relating to the gathering of individuals' and 'general restrictions on the freedom of movement within that county or municipality, including but not limited to the imposition of curfews', and directed that 'No municipality, county, or any other agency or political subdivision of this State shall enact or enforce any order, rule, regulation, ordinance, or resolution' that conflicts with or impedes Executive Order No. 107, excepting only 'Online marketplaces for arranging or offering lodging' and 'Municipal or county parks', with penalties under N.J.S.A. App. A:9-49 and -50. Camden County's own March 14, 2020 proclamation had already provided that 'public health orders, as given by the State of New Jersey shall supersede any and all orders previously given by the County of Camden' (Ex. MET-PHL-079). From March 21, 2020, therefore, the business, gathering and movement restrictions operating in Camden County were the State's Executive Orders (Nos. 107, 122, 125, 142 to 157, 192, 242, 243, 244, 251, 252, 253 and 264 among them), cited by name and date; the county's own instruments governed county operations, facilities and employees.
