ScopeTampa Bay metropolitan area: Hillsborough County (Emergency Policy Group, Board of County Commissioners, County Administrator), City of Tampa (Mayor), Pinellas County (Board of County Commissioners and Official Authority), City of St. Petersburg (Mayor), Pasco County (Board and County Administrator), the Sixth and Thirteenth Judicial Circuits, the Hillsborough Area Regional Transit Authority and the Pinellas Suncoast Transit Authority. Statewide instruments (EO 20-52, 20-68, 20-70, 20-71, 20-91/20-92, 20-112, 20-120, 20-123, 20-139, 20-244, 20-297, 21-81, 21-101, 21-102, 21-175; SB 2006 (ch. 2021-8); DBPR Emergency Order 2020-09; DOH rule 64DER21-12.

The Tampa Bay regime was county- and city-driven from March 12, 2020 (Hillsborough County Emergency Policy Group and City of Tampa local emergencies; Pasco Resolution 20-102 the same day; Pinellas Resolution 20-16 on March 13, 2020) and became a face-covering regime from June 2020 until the Governor suspended every local COVID-19 restriction on May 3, 2021 (EO 21-102), with local states of emergency, court administrative orders, transit measures and a municipal employee vaccination directive continuing through September 30, 2021. 2020 Q2 (wages after March 12, 2020 included). Hillsborough County acted first and hardest: the County Administrator's order of March 16, 2020 (commencing noon March 17) closed every restaurant, bar, private club and food-or-drink establishment daily by 10:00 p.m. and cut their occupancy by 50 percent (Ex. 020); the March 19 order set hours of 6:00 a.m. to 10:00 p.m. and prohibited every public or private gathering of more than 10 people, naming fitness centers, health clubs, private clubs and theaters (Ex. 002); Administrator Order 20-05 of March 20 confined food service to take-out, delivery and drive-through and kept the ten-person gathering prohibition (Ex. 003). The EPG's Safer-At-Home Order, adopted March 26 and effective 10:00 p.m. March 27, 2020, directed all residents to stay at home as much as possible twenty-four hours a day, seven days a week, subject to enumerated exceptions (Ex. 005), and its March 30 amendment confined hotel, motel and vacation-rental lodging to Essential Lodgers under EO 20-70 (Ex. 006). The EPG imposed a countywide 9:00 p.m. to 5:00 a.m. curfew from April 13, 2020, punishable under section 775.082 or 775.083, and rescinded it on April 16 (Ex. 001). The City of Tampa mirrored the county (Mayoral Order No. 1, March 17, 2020, Ex. 018), declared its own emergency March 12 and 16, 2020 (readopted and extended weekly), closed all City parks, recreation facilities and pools and cancelled every program, tournament and event (EO 2020-10, May 4, 2020, Ex. 021), and from May 5, 2020 regulated outdoor dining under its Lift Up Local orders (Ex. 022, 024, 027, 029). Pinellas County closed every public beach and beach parking lot from 11:59 p.m. March 20, 2020 (Res. 20-17, Ex. 057), ordered alcohol service to end at 10:00 p.m. from March 18 (Ex. 056), adopted its own Safer at Home Order on March 25, 2020 ordering non-essential businesses to close storefront operations (Res. 20-20, Ex. 058), ordered every retail business outside EO 20-91's essential categories to close on April 2, 2020 (Res. 20-23, Ex. 059), and terminated both orders effective with EO 20-112 on May 4, 2020 (Res. 20-39, Ex. 063), lifting its remaining restrictions June 1, 2020 (Res. 20-46, Ex. 064). St. Petersburg closed places of public assemblage to events over 50 people and cut venue occupancy to 50 percent on March 16, 2020 (Ex. 035), cut alcohol service at 9:00 p.m. on March 19 (Ex. 036), adopted the State and County orders as City-enforced orders and suspended sidewalk-cafe and extended-hours permits on March 26 (Ex. 038), and barred alcohol sales from midnight to 8:00 a.m. on March 27 (Ex. 039). 2020 Q3. Every county in the metro mandated face coverings in indoor business locations, enforced against the business operator: Hillsborough from June 22, 2020 (enforcement June 24, 5:00 p.m.; extended and amended June 29, July 6 and August 13; Ex. 008-009), Tampa from June 19, 2020 (EO 2020-27, replaced June 24 by EO 2020-30 and August 19 by EO 2020-42; Ex. 025-028), Pinellas by emergency Ordinance 20-14 effective 5:00 p.m. June 24, 2020 with fines of $100 and $250 (Ex. 065), St. Petersburg by EO 2020-24 (employees, June 19) and EO 2020-26 (all adults in places of public assemblage, June 23), then by adopting the County ordinance as a municipal violation on June 25 (Ex. 043-046), and Pasco from 5:00 p.m. June 25, 2020 (Ex. 069). Hillsborough abolished the EPG on August 5, 2020 (Ordinance 20-15) and vested the emergency and face-covering orders in the Board and the County Administrator, who extended the local emergency every seven days thereafter. 2020 Q4 and 2021 Q1. EO 20-244 (September 25, 2020) barred local orders from closing businesses or fining individuals; the face-covering mandates survived as orders on business operators (Tampa EO 2020-42; Hillsborough extensions #34, #36, #43; St. Petersburg EO 2020-27 as amended October 2020 with a business-planning requirement effective October 5, 2020; Pinellas Ordinance 20-14). Super Bowl LV brought new orders: Pinellas Emergency Order 21-3 (January 21, 2021) required an approved COVID-19 Event Safety Plan with mandatory face coverings for every outdoor event over 1,000 people (Ex. 067); St. Petersburg EO 2021-04 extended plan requirements to events of 250 or more (Ex. 051); Tampa EO 2021-07 (January 28, 2021) required face coverings outdoors in the Event Zone and Entertainment Districts (Ex. 030). 2021 Q2. EO 21-102 (May 3, 2021) suspended every remaining local COVID-19 order; Hillsborough's County Attorney reported on May 5 that the face-coverings mandate was no longer in effect while the local emergency continued; St. Petersburg terminated all its COVID orders with limited exceptions on May 6, 2021 (EO 2021-19, Ex. 052); the Sixth Circuit returned to in-person proceedings with voluntary masks effective June 21, 2021 (AO 2021-019, Ex. 053). 2021 Q3. In force July 1 through September 30, 2021: the Hillsborough local state of emergency (Extensions #68 through #81, Ex. 015-017), whose section 3 kept every provision of the March 12, 2020 order 'not in conflict with the Governor's Executive Orders 21-101, 21-102, or State Statutes'; the City of Tampa emergency (EO 2021-24 of May 5, 2021, extended weekly through EO 2021-45 of September 1, 2021, Ex. 031); Tampa EO 2021-46 (Revised Lift Up Local, September 1, 2021); Tampa EO 2021-47 (September 7, 2021), ordering every City employee to be fully vaccinated or to test weekly and wear an N95 or KN95 mask daily, for ninety days (Ex. 033); the Sixth Circuit's courthouse mask requirement in AO 2021-029, rescinded only on November 15, 2021 (Ex. 054, 084); the federal transit mask mandate on HART and PSTA; and the State's school-mask instruments of July 30 and August 6, 2021. Not in force in Q3 2021: every county and city face-covering, occupancy, hours, curfew, beach, event-plan and safer-at-home order, all suspended May 3, 2021 and void from July 1, 2021 under SB 2006.

End of general restrictions

Instrument Governor's Executive Order 21-102 (May 3, 2021), suspending all local COVID-19 emergency orders and restrictions on individuals and businesses (cite from the Florida State file); implemented locally by the Hillsborough County Attorney's May 5, 2021 report to the Board (face-coverings mandate 'no longer in effect'), St. Petersburg EO 2021-19 (May 6, 2021, terminating all previous City COVID-19 orders with limited exceptions, Ex. MET-TPA-052) and the Hillsborough extension orders' section 3 from May 27, 2021 (Ex. MET-TPA-014). Before that date the general business restrictions ended in stages: Pinellas Res. 20-39 terminated the Safer at Home and retail-closure orders effective May 4, 2020 with EO 20-112 (Ex. 063) and Res. 20-46 lifted the remaining local restrictions June 1, 2020 (Ex. 064); Hillsborough's Safer-At-Home Order was superseded by EO 20-91 on April 3, 2020 and its gathering and hours orders by EO 20-112 on May 4, 2020; EO 20-244 (Sept. 25, 2020) removed local power to close businesses or fine individuals.

What remained in force

Local states of emergency (Hillsborough weekly extensions through and beyond Sept. 30, 2021; City of Tampa EO 2021-24 and weekly extensions through EO 2021-45 and later); Tampa's Lift Up Local outdoor-dining regime (EO 2021-46, Sept. 1, 2021); Tampa EO 2021-47 employee vaccination-or-testing directive (Sept. 7, 2021, 90 days); Sixth Judicial Circuit courthouse mask requirement (AO 2021-029, rescinded Nov. 15, 2021) and remote-proceeding authority (AO 2021-019); Thirteenth Circuit courtroom mask rule (AO S-2021-028, May 7, 2021) and successors; the federal CDC/TSA mask mandate on HART, PSTA and Tampa International Airport (Federal file); State school-mask instruments (EO 21-175, July 30, 2021; DOH rule 64DER21-12, Aug. 6, 2021; State file).

The State and the local orders

20-23, ordering non-essential retail to close under EO 20-91's categories, Ex. 059); (2) EO 20-112 (April 29, 2020) and its successors set the reopening phases that the counties implemented by terminating their own orders (Pinellas Res. 20-39, Ex. 063; Hillsborough recitals in Ex. 011); (3) EO 20-244 (September 25, 2020) provided that no local COVID-19 emergency ordinance could prevent an individual from working or operating a business, barred restaurant limits below 50 percent, and suspended the collection of fines and penalties against individuals, so that from that date the metro's face-covering orders ran against business operators only (Tampa EO 2020-42, Ex. 028; Hillsborough Extension #36 recitals, Ex. 011; St. Petersburg EO 2020-27 as amended, Ex. 050), and EO 20-297 (November 2020) continued it; (4) EO 21-102 (May 3, 2021) suspended all remaining local COVID-19 orders and mandates, and SB 2006 (ch. 2021-8, Laws of Fla., effective July 1, 2021) limited local emergency orders to seven days, renewable to forty-two, and empowered the Governor to invalidate them; EO 21-81 (April 2, 2021) and section 381.00316 barred vaccination-proof requirements for entry, which Tampa EO 2021-47 expressly recites and avoids (Ex. 033). Litigation: the Thirteenth Judicial Circuit upheld the constitutionality of the Hillsborough EPG/BOCC face-coverings order in summer 2020. Hillsborough's own orders recite the preemption: from May 27, 2021 every extension preserves only provisions 'not in conflict with the Governor's Executive Orders 21-101, 21-102, or State Statutes' (Ex. 014-017).

Hotels and short-term rentals

Hillsborough amendment of Mar. 30, 2020 confined hotels, motels and vacation rentals to Essential Lodgers under EO 20-70 (Ex. 006 sec. 9); State EO 20-87 vacation-rental ban (Mar. 27-May 2020) lifted county by county on DBPR approval of county plans: Hillsborough approved May 22, 2020 (Ex. 010), Pasco plan submitted May 2020 (Ex. 070); Pinellas hotel-pool restrictions removed May 28, 2020 (Ex. 064).

Offices and telework

Pinellas Res. 20-20 required businesses without Essential Services to close storefronts and continue only internal and minimum basic operations, enforcing CDC distancing as to their workforce (Ex. 058 sec. D); Hillsborough Safer-At-Home directed residents to stay home except for enumerated purposes including commuting to employment (Ex. 005 sec. 3(k)); public meetings moved to communications media technology (Pinellas EO 20-3, Ex. 060; St. Petersburg EO 2020-12, Ex. 041).

Manufacturing

No local closure; CISA critical-infrastructure personnel exempted by Hillsborough amendment of Mar. 30, 2020 (Ex. 006 sec. 3(pp)); indoor face-covering orders applied to business locations open to the public only.

Exempted as essential in Hillsborough Safer-At-Home sec. 3(s) (contractors, utility workers, tradesmen; Ex. 005) and Pinellas Res. 20-20 essential services; St. Petersburg permitting operated under revised COVID procedures (City PDS operations documents, not saved).

Pinellas Res. 20-35 (childcare play equipment reopening with conditions, May 2020) and Res. 20-46 (restrictions on childcare playground equipment removed May 28, 2020; Ex. 064); Pasco face-covering amendment exempted children in daycare (Ex. 072).
