Summary

The maritime layer of the COVID-19 order regime ran from January 24, 2020 (MSIB 01-20) through and beyond September 30, 2021, and it reached every employer whose goods, people or vessels touched a U.S. port. 2020 Q1 run-up and Q2. On February 2, 2020 the Coast Guard's MSIB 02-20 made illness aboard any vessel a 'hazardous condition' under 33 C.F.R. 160.216 that 'must be immediately reported' to the Captain of the Port, recited the 42 C.F.R. 71.21 duty of masters to report ill or dead persons to CDC, announced that passenger vessels with passengers from China within 14 days 'will be denied entry into the United States,' and directed that crews of cargo vessels from China 'will be required under COTP authority to remain aboard the vessel except to conduct specific activities directly related to vessel cargo or provisioning operations.' Changes 1 (Mar. 9), 2 (Mar. 13), 3 (Mar. 16), 4 (Apr. 23) and 5 (May 27, 2020) extended the same conditions to Iran, the Schengen Area, the United Kingdom and Ireland, and then to all arriving vessels ('Vessel arriving to or traveling between any U.S. port or place must follow reporting and infection control measures'). MSIB 06-20 (Mar. 13) warned that vessels failing to report 'may face delays and disruption to passenger and cargo operations including a requirement to return to' sea. On March 15, 2020 the Captain of the Port San Francisco imposed a safety zone around the cruise ship GRAND PRINCESS (85 Fed. Reg. 15724), prohibiting all vessels from a 500-yard zone through April 15, 2020. MSIB 07-20 (Mar. 18; Changes Apr. 17 and May 7) told facility operators that the 33 C.F.R. part 105 security regime 'remains in force' and that any facility unable to comply 'must contact the Captain of the Port to request and receive permission to temporarily deviate.' MSIB 08-20 (Mar. 19; Changes Mar. 30, June 4, Aug. 20, Sept. 30, Dec. 22, 2020) closed all Regional Exam Centers 'until further notice' and extended expiring merchant mariner credentials in steps that ultimately ran to October 31, 2021. MSIB 09-20 (Mar. 26) suspended detention of vessels for expired certificates until October 1, 2020 and allowed 90-day deferrals of required inspections; MSIB 10-20 (Mar. 27) kept 46 C.F.R. part 16 drug testing in force 'during the COVID-19 national emergency'; MSIB 11-20 (Mar. 27) identified the Marine Transportation System workers who were 'considered essential in regions impacted by COVID-19 quarantine and shelter-in-place orders,' which is the Coast Guard's own recognition that shelter-in-place orders were then operating on ports; MSIB 13-20 (Apr. 3; Changes Aug. 31 and Dec. 22, 2020, Apr. 21, 2021) applied enforcement discretion to expired TWICs and delayed TWIC-reader enforcement in steps to January 1, 2022, matched by TSA's exemption (85 Fed. Reg. 21017) extending TWICs expired on or after March 1, 2020 by 180 days through July 31, 2020; MSIB 14-20 (Apr. 9) extended ballast-water compliance dates up to twelve months. The Seventh District's MSIB 01-20 (Mar. 29, 2020) told foreign passenger vessels with more than 50 persons aboard in the District to 'increase their medical capabilities, personnel and equipment in order to care for individuals with ILIs for a indefinite period of time,' conditioned medical evacuations on Coast Guard flight-surgeon concurrence and required daily reports of ill persons to the COTP, 'effective immediately.' MARAD's Advisory 2020-006 (Mar. 15 - Aug. 9, 2020) routed the industry to the MSIBs. The Federal Maritime Commission opened Fact Finding 29 on March 31, 2020 (85 Fed. Reg. 19146) to address 'cargo delivery system challenges related to COVID-19,' Fact Finding 30 on the cruise industry (85 Fed. Reg. 26978), and issued COVID-19 orders relaxing paper filing (85 Fed. Reg. 29945) and service-contract filing (85 Fed. Reg. 23227; extension to June 1, 2021 at 85 Fed. Reg. 63274). On the customs side, CBP announced case-by-case payment extensions on March 20, 2020 (CSMS 42097586), withdrew them on March 26-27 (CSMS 42161666, 42179313), postponed the April 1, 2020 broker examination (85 Fed. Reg. 17091), moved trade processing to electronic channels (CSMS 42283516, Apr. 6), and, under Executive Order 13916 (Apr. 18, 2020) and the Treasury/CBP temporary final rule adding 19 C.F.R. 24.1a (85 Fed. Reg. 22349, effective Apr. 20, 2020), postponed duty deposits 90 days for importers whose operation was 'fully or partially suspended during March or April 2020 due to orders from a competent governmental authority limiting commerce, travel, or group meetings because of COVID-19.' That rule is the federal government's own contemporaneous application of the Suspension Clause's vocabulary to importers. Port authorities converted the federal and State orders into terminal conditions: PortMiami reported the cruise lines' cessation of sailings from March 13-14, 2020 and moved its administration to CDC protocols and remote work (Mar. 18, 23); Port Tampa Bay cancelled its board meeting and reported cruise suspensions (Mar. 16); the Port of Virginia restricted visitors (Mar. 19) and, on April 8, 2020, imposed truck-gate rules under which 'Failure to comply with the following guidelines will result in removal from the terminal'; the Georgia Ports Authority limited its Credentialing Center to one visitor at a time (Mar. 23) and began temperature checks at all access control points, turning away anyone at 100.4 degrees or higher (Apr. 21); the Port of Seattle suspended the 2020 cruise season 'indefinitely,' suspended construction April 9-13, admitted only 'essential' workers on site and restricted marina access under an emergency order (Apr. 10, May 1); the Port of Oakland moved its Board to telephone meetings under the State and Alameda County shelter-in-place orders (Mar. 24); PhilaPort kept its terminals open but closed its administrative offices 'as per the Governor's directive' from March 2020 until June 2, 2021; the Los Angeles Port Police imposed temperature screening on all personnel from April 2, 2020. The California Board of Pilot Commissioners certified on March 20, 2020 that State-licensed pilotage 'is an essential government service within the meaning of the current Shelter in Place/Stay at Home Orders.' 2020 Q3 and Q4. The reporting and crew-restriction regime (MSIB 02-20 Ch. 5), the facility deviation regime (MSIB 07-20 Ch. 2), the credential and TWIC extensions (MSIB 08-20 Ch. 3-5; MSIB 13-20 Ch. 1-2), the CDC No Sail Order recited in the MSIBs (FED-A's exhibit), the FMC service-contract exemption and the Fact Finding 29 supplemental order of November 19, 2020 (investigating alliance carriers' practices at New York/New Jersey and Los Angeles/Long Beach under 46 U.S.C. 41102(c)) were in force throughout. 2021 Q1 and Q2. MSIB 02-20 Change 6 (Jan. 29, 2021) and Change 7 (May 5, 2021) continued the reporting and crew conditions; MSIB 02-21 (Feb. 1, 2021) implemented Executive Order 13998 and the CDC conveyance mask order on 'all commercial vessels,' warned that non-complying vessels 'may be issued a Captain of the Port (COTP) order directing the vessel's movement and operations,' and Change 1 (Mar. 22, 2021) extended the requirement to sea ports as transportation hubs ('Operators of sea ports must use best efforts to ensure that any person entering or on the premises of the port wears a mask'); MSIB 04-21 (Mar. 17, 2021) governed crew changes; MARAD Alert 2021-002A carried the CDC pre-departure testing order for arriving air passengers into mariner travel. 2021 Q3. The federal maritime layer therefore supplies force-of-law instruments in every claimable quarter, including the third quarter of 2021.

A context record is a guidance document, an announcement, an enforcement summary or a data release that explains what the binding instruments did and how the regulator applied them. No single instrument ended the maritime layer. The CDC conveyance and transportation-hub mask order implemented by MSIB 02-21 (Changes 1-3) remained in force past September 30, 2021 (it was vacated by court order on April 18, 2022); MSIB 08-20 Change 5's credential extensions ran to October 31, 2021; MSIB 13-20 Change 3's TWIC enforcement discretion ran to January 1, 2022; the MSIB 02-20 reporting and crew conditions (Change 7, May 5, 2021) were the current bulletin at the end of the period.

Preemption. Not applicable as a State question. Federal maritime instruments operate alongside State and local orders: MSIB 02-21 Change 3 expressly preserves 'state, local, tribal, or territorial laws, rules, and regulations that still require the wearing of masks in outdoor areas,' and MSIB 11-20 operates within, not against, State shelter-in-place orders by identifying the maritime workers those orders exempted. Port authorities' terminal rules are conditions of access under their tariffs and MTSA facility security plans and coexist with the State and county orders they implement.
