Operative words
(a) Each employer— (1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees; (2) shall comply with occupational safety and health standards promulgated under this chapter.
What it required
Every employer engaged in a business affecting commerce must furnish a workplace free from recognized hazards likely to cause death or serious physical harm and comply with OSHA standards (including 29 C.F.R. § 1910.132 on PPE and § 1910.134 on respirators); in Nebraska this duty was enforced directly by federal OSHA, whose COVID-19 enforcement instruments are Ex. FED-080 to FED-084.
