Operative words

(2) To enforce all laws of this state concerning public health.... (14) To inspect and enforce rules to control the sanitary conditions of... workshops, factories, labor camps, places of entertainment, hotels,... all other places open to the general public and inviting public patronage or public assembly... and places where trades or industries are conducted

Penalty

Violation of the article or of any rule or order under it: fine of $50 to $500 (W. Va. Code § 16-1-18; Ex. DUT-WV-007)

What it required

Submission of every workshop, factory, place of entertainment, hotel and every other place 'open to the general public and inviting public patronage or public assembly' to the Commissioner's sanitary inspection and enforcement; (a)(3) charges the Commissioner to investigate 'epidemics and endemic conditions' and 'the effects of environment, employment, habits, and circumstances of life on the public health'; (a)(15) to enforce the legislative rules on 'occupational and industrial health hazards.'

Retrieval note

The 2020 County Alert System, the nursing-home testing orders (Exs. WV-022, WV-029, WV-053, WV-064) and the OHFLAC reopening plan (Ex. WV-080) were administered by the Department of Health and Human Resources under these powers. W. Va. Code § 16-1-4 (read, not saved) directs the Secretary's rules to 'The sanitary condition of all institutions... workshops, factories, labor camps, all other places open to the general public and inviting public patronage or public assembly... and places where trades or industries are conducted.'.
