ScopeCity of Detroit (Detroit Health Department emergency orders under MCL 333.2451 and 333.2453; Detroit City Council; Detroit Public Schools Community District), Wayne County outside Detroit (Wayne County Local Health Department emergency public health orders under MCL 333.2453; County Executive releases; Prosecutor), Oakland County (Oakland County Health Division emergency orders under MCL 333.2453; County Executive declaration), Macomb County (Macomb County Health Department orders and notices), the Third Judicial Circuit Court (Wayne County), the 36th District Court (Detroit), the Sixth Judicial Circuit Court (Oakland County), and the Suburban Mobility Authority for Regional Transportation (SMART). The Detroit metropolitan area ran a three-layer regime from March 13, 2020 through and beyond September 30, 2021: the Governor's executive orders (to October 2, 2020) and the MDHHS epidemic orders (October 5, 2020 to June 22, 2021) on top, the three county health officers and Detroit's Chief Public Health Officer issuing their own emergency orders under MCL 333.2453 beneath them, and the trial courts and the regional transit authority issuing orders of their own. 2020 Q2 (with the March 13-31 run-up): Oakland County moved first, reducing occupancy at every food service establishment, entertainment venue and fitness center by 50 percent from March 16, 2020 (Ex. MET-DET-017), ordering daily screening at child-care centers from March 23 (Ex. MET-DET-018), closing playground equipment (Ex. MET-DET-019) and every shopping mall in the county from noon March 21 (Ex. MET-DET-020), and, by Emergency Order 2020-5 of March 24, 2020, effective noon March 25, compelling every business still open under the Governor's stay-home order to screen all staff daily, exclude the symptomatic, exposed and recently travelled for 3 to 14 days, implement a six-foot distancing plan and limit capacity inside its facilities (Ex. MET-DET-029, -022). Wayne County did the same for every open non-child-care business in the county outside Detroit by Order 20-02, effective 7:00 p.m. March 26, 2020, and for child-care providers by Order 20-01 (Ex. MET-DET-031, -052). Oakland's Order 2020-07 (April 13, effective April 14, 2020) added a face-covering duty for essential services with face-to-face public contact (Ex. MET-DET-021), continued by Order 2020-10 in May 2020 (Ex. MET-DET-025); Order 2020-11 closed every public swimming pool in the county from May 28, 2020 (Ex. MET-DET-026); Macomb County's Health Department closed public pools by its Emergency Public Health Order 2020-01 and rescinded the closure on June 1, 2020 (Ex. MET-DET-050). The 36th District Court limited its dockets from March 16, 2020, suspended walk-ins, restricted building entry, imposed an eviction moratorium on March 13 and extended it through July 2020 (Ex. MET-DET-016, -023, -049), and required a mask for courthouse entry from May 1, 2020 (Ex. MET-DET-044); the Sixth Circuit Court in Oakland County confined itself to emergency and essential matters and adjourned jury trials by orders of March 23, April 9, May 8 and May 29, 2020 (Ex. MET-DET-006, -030, -040) and then governed its return by a Protocol Order of June 12, 2020 in force until further notice (Ex. MET-DET-041, -042, -043); SMART made every ride free from March 16, 2020, cut service to hourly frequency from March 31 and suspended commuter routes from April 8, 2020 (Ex. MET-DET-035, -034). Detroit's Health Department closed Monroe Street in Greektown to the public on summer weekend evenings from June 26, 2020 (Ex. MET-DET-002). 2020 Q3: the Third Circuit Court returned to Phase One on July 7 and Phase Two on August 17, 2020 with employee screening, face coverings and remote work (Ex. MET-DET-007, -008); Oakland's business-screening, pool and playground orders and Wayne's Order 20-02 remained on their own terms; SMART's Safety Playbook (issued June 1, 2020) required face coverings of every employee. 2020 Q4: within a week of the Supreme Court's October 2, 2020 decision voiding the Governor's orders, every health officer in the metro re-imposed the regime locally: Oakland Order 2020-12 (October 3) required face coverings in every indoor public space, outdoors without six feet, and on public and hired transportation (Ex. MET-DET-027); Wayne County's orders of October 8 and 16, 2020 carried forward masks, gathering limits, employee screening and, from October 16, the MIOSHA emergency rules including the remote-work policy mandate (Ex. MET-DET-014, -032, -036); Detroit's twenty-five-page Emergency Order for Control of Epidemic of October 9, 2020 required masks of every person leaving home and of every customer served, closed indoor service at bars earning more than 70 percent of receipts from alcohol, capped restaurants at 50 percent and retail at 25 percent, capped gatherings at 10 indoors (20 percent of fixed seating or 20 per 1,000 square feet to a maximum of 500), imposed sector rules on construction, manufacturing, offices, research labs, retail, health care, in-home services and casinos (15 percent), required masks in every school and prevailed over any conflicting local ordinance, enforceable as a misdemeanor under MCL 333.2443 (Ex. MET-DET-001); the Third Circuit set jury-trial parameters (Ex. MET-DET-009) and the 36th District Court suspended in-person matters on November 5 and all but emergency matters from November 18 to December 8, 2020 (Ex. MET-DET-045, -048). 2021 Q1 and Q2: the Detroit, Oakland and Wayne general orders continued on their own terms while MDHHS's orders ran to June 22, 2021; the Detroit and Wayne health officers declared local states of emergency on March 29-30, 2021 (to May 31), extended by Detroit on May 20 (to June 30) and June 23, 2021 (Ex. MET-DET-003, -004, -033, -055); the Third Circuit fell back to Phase One on April 7, 2021, moved to Phase Two on April 27 and Phase Three on June 7, 2021 with screening, face coverings and remote proceedings continuing (Ex. MET-DET-010, -011, -012). 2021 Q3: on July 1, 2021 the Third Circuit's Phase Three order, the Sixth Circuit's Protocol Order, Detroit's June 23 emergency order and SMART's Playbook were in force and the federal transit mask order governed every DDOT and SMART ride; on August 24 and 27, 2021 the Oakland and Wayne County health officers ordered masks for every person in every school and day care in their jurisdictions, regardless of vaccination status, until further notice (Ex. MET-DET-013, -015), Detroit's public school district required masks of all persons in its buildings and weekly testing of all staff (Ex. MET-DET-046), Detroit's health officer declared a continued emergency for September 1 to December 31, 2021 (Ex. MET-DET-005), and SMART's Playbook of August 6, 2021 required masks of every employee and, under federal law, every rider (Ex. MET-DET-039). The Legislature's budget rider of September 29, 2021 (2021 PA 87, sec. 250) purported to bar local mask orders for minors; the county orders stayed in force until February 2022.

End of general restrictions

Instrument No local rescission instrument located for the Detroit Emergency Order for Control of Epidemic (Oct. 9, 2020), Oakland County Emergency Orders 2020-10 and 2020-12, or the Wayne County Updated Emergency Public Health Order (Oct. 16, 2020); each ran 'until further order' or 'until it is determined by the Health Officer... that the threat... is no longer present' and was modeled on the MDHHS Gatherings and Face Mask Orders, which MDHHS rescinded on June 17, 2021 effective June 22, 2021.

What remained in force

The State and the local orders

Michigan did not preempt local health officer orders during the period. MCL 333.2453 authorizes a local health officer, upon determining that control of an epidemic is necessary, to 'issue an emergency order to prohibit the gathering of people for any purpose' and to establish procedures to be followed; MCL 333.2443 makes violation of a local health officer's order a misdemeanor (imprisonment up to 6 months or a fine up to $200, recited in Ex. MET-DET-001 at 25). The Michigan Supreme Court's decision of October 2, 2020 in In re Certified Questions (No. 161492) reached only the Governor's executive orders; the Wayne County Health Officer's orders of October 8 and 16, 2020 recite that the decision 'does not negate in any way a local health department's authority to issue a public health order like this order' (Ex. MET-DET-014, -032), and the Wayne County Prosecutor dismissed pending prosecutions under the Governor's orders while the local and MDHHS orders remained (Ex. MET-DET-053). Detroit's order of October 9, 2020 provides that 'A provision of this order will prevail over any conflicting provision of a local charter, ordinance, or rule' (Ex. MET-DET-001 at 25). The Legislature's FY 2022 omnibus appropriation act, 2021 PA 87 (approved and effective September 29, 2021), section 250 of the DHHS budget, provides: 'The director or a local health officer shall not issue or enforce any orders or other directives that require an individual in this state who is under the age of 18 to wear a face mask or face covering'. The Oakland and Wayne County school mask orders of August 24 and 27, 2021 nonetheless remained in force: Oakland amended Order 2021-01 on November 22, 2021 (Ex. MET-DET-028) and rescinded it effective February 28, 2022 (county release of Feb. 11, 2022, read); Wayne rescinded its order effective 8:00 a.m. February 17, 2022 (county announcement reported Feb. 17, 2022, read). Parents sued three Oakland County districts and the Health Division in February 2022 over Order 2021-01.

Restaurants and bars

Oakland: 50 percent occupancy Mar. 16-Apr. 5, 2020 (Ex. 017); State dine-in closure Mar. 16-June 8, 2020 (EO 2020-9 et seq.). Detroit: Monroe Street (Greektown) closed to the public on summer weekend evenings from June 26, 2020 (Ex. 002); from Oct. 9, 2020 bars over 70 percent alcohol receipts closed indoors, 50 percent seating, seated table service only, masks until seated, dance permits suspended (Ex. 001 at 3-5). Macomb: Clinton Township restaurant closed June 22, 2020 and exposed employees required to test negative (Ex. 054). County orders tracked MDHHS through June 22, 2021.

Oakland: all shopping malls closed noon Mar. 21-Apr. 17, 2020 (Ex. 020); business screening, distancing and capacity limits from Mar. 25, 2020 (Ex. 029, 022, 021, 025); face coverings at essential services from Apr. 27, 2020 (Ex. 021). Wayne: same duties from Mar. 26, 2020 (Ex. 031). Detroit: from Oct. 9, 2020 stores under 50,000 sq ft capped at 25 percent of occupancy, larger stores at 20 per 1,000 sq ft, no service to unmasked customers (Ex. 001 at 2-3, 10-11).

Personal care

Oakland Order 2020-11 closed pools at hotels, motels and apartment complexes from May 28, 2020 (Ex. 026); Detroit Oct. 9, 2020 order's mask, capacity and gathering rules reached hotel restaurants, bars and event space (Ex. 001).

Offices and telework

Wayne Oct. 16, 2020 order incorporates the MIOSHA rule that 'an employer shall create a policy prohibiting in-person work for employees to the extent that their work activities can feasibly be completed remotely' (Ex. 032 at 2); Detroit Oct. 9, 2020: offices must stagger, distance, screen, 'Promote remote work to the fullest extent possible', research labs must 'Require all office and dry lab work to be conducted remotely' (Ex. 001 at 7, 10-11); Third Circuit LAOs: employees work remotely where feasible, staggered shifts (Ex. 008, 012).

Manufacturing

State shutdown Mar. 24-May 11, 2020 (EO 2020-21, -77). Detroit Oct. 9, 2020: daily entry screening with temperature screening, rotational shifts, barriers, shutdown of areas for cleaning (Ex. 001 at 8-9); Oakland and Wayne screening orders reached every open plant from Mar. 25-26, 2020 (Ex. 029, 031).

Construction

State shutdown Mar. 24-May 7, 2020 (EO 2020-21, -70). Detroit Oct. 9, 2020: daily entry screening of employees, contractors and suppliers, dedicated entry points, choke-point controls, restricted movement between sites (Ex. 001 at 8).

Real estate

36th District Court eviction moratorium Mar. 13-July 2020 and beyond (Ex. 023, 049); 36th District Court in-person landlord-tenant matters suspended Nov. 5, 2020 and all but emergency evictions Nov. 18-Dec. 8, 2020 (Ex. 045, 048); Detroit water-service restoration duties (Ex. 001 at 24).

Hospitals and long-term care

Wayne County orders of Oct. 8 and 16, 2020 carry forward EO 2020-191 protections for long-term care residents and staff (Ex. 014, 032); Detroit Oct. 9, 2020 order sections on health care; MDHHS residential care orders (State).

Dental and elective health care

State EO 2020-17 (Mar. 21-May 29, 2020). Detroit Oct. 9, 2020: outpatient facilities including dental offices must screen every patient, mask patients, limit waiting rooms and appointments, 'Employ telehealth and telemedicine to the greatest extent possible' (Ex. 001 at 11-12).

Schools

State closure Mar. 16, 2020 (EO 2020-5) and for the year (EO 2020-35; Ex. 048 not saved). Detroit Oct. 9, 2020: face coverings for all staff and students, no multi-classroom indoor assemblies, building closure rules in Phases 1-3 (Ex. 001 at 18-19).
