Kentucky's regime was the Governor's and the Cabinet for Health and Family Services': Executive Order 2020-215 (state of emergency, March 6, 2020), the CHFS orders closing dine-in service and banning mass gatherings (March 16-19, 2020), Executive Order 2020-246 (non-life-sustaining retail, March 22-23, 2020), Executive Order 2020-257 (Healthy at Home, March 25, 2020), Executive Order 2020-258 (travel, March 30, 2020), the Healthy at Work capacity steps from May 11, 2020, Executive Order 2020-586 (face coverings, July 9, 2020, effective 5:00 p.m. July 10, 2020, renewed monthly), Executive Order 2020-968 (winter closures, November 18 to December 13, 2020), the June 11, 2021 termination of the statewide mask, distancing and capacity orders, Executive Order 2021-585 and the emergency regulations 702 KAR 1:195E and 902 KAR 2:213E (school and child-care masks, August 10-12, 2021), HJR 1 of the September 2021 Special Session (extending the State's COVID-19 executive actions to January 15, 2022, Acts ch. 1, September 7, 2021) and SB 1 (nullifying the school and child-care mask regulations and directing each district to adopt a COVID-19 operations plan, Acts ch. 4, September 9, 2021). First, the Mayors declared local states of emergency (Louisville's executive order of March 13, 2020, extended to May 10, 2020 by Executive Order 2020-002 of March 24, 2020, Exs. 023, 024, 043; Lexington's Executive Order 2020-01, recited in five ordinances, 044) and under them cancelled all Metro-hosted events, closed libraries, community centers, aquatic centers, the Zoo, playgrounds, ballfields, golf courses (Lexington), courts and dog parks (Exs. 023-026, 034), moved their workforces to telework, screened first responders for symptoms, closed government buildings to walk-in visitors (Louisville from March 17, 2020, Ex. 025; Lexington from March 23, 2020 to June 11, 2021, with about 700 employees telecommuting, Exs. 019, 035) and suspended the meetings of boards and commissions (Ex. 020). Second, the Transit Authority of River City cut every route to Saturday schedules from March 20, 2020, capped passengers at 25 per bus, laid off 133 operators, limited ridership to 'essential trips only' from April 3, 2020 and required face coverings and rear-door exit from April 26, 2020, eleven weeks before the State's mandate (Exs. 009-011, 030-032). Third, the Fayette County Clerk closed to the public from March 17, 2020, suspended vehicle transfers, notary commissions and marriage licenses, held recordings unprocessed, stayed closed to the public until at least July 6, 2020 and did not resume in-person transactions until April 12, 2021 (Exs. 008, 021, 022, 036); its Elections Department was shut for a two-week quarantine in September 2020 (Ex. 038); the Jefferson County Clerk's offices were closed from mid-March to July 2020 (049). Fourth, both legislative councils enacted emergency ordinances that suspended zoning, sidewalk-permit and alcohol rules so restaurants, bars and retailers could operate outdoors under the Governor's 33 percent capacity requirements: Louisville Ordinance 057-2020 (May 14-15, 2020, effective May 22, 2020 until 30 days after the State emergency ceases), amended June 24, 2021 by Ordinance 085-2021 to run to at least January 30, 2022 because the industry 'is still recovering from the impacts of the COVID-19 restrictions' (Exs. 003, 004); Lexington Ordinances 42-2020, 54-2020, 80-2020, 103-2020 and 18-2021 (May 19, 2020 through October 31, 2021), each conditioning the use of public space on compliance with 'social distancing requirements implemented by Governor Beshear' (Exs. 007, 013, 014, 042, 015). The Louisville Metro Department of Public Health and Wellness enforced the State's orders by shutdown orders against businesses (seven by April 2, 2020, on more than 1,100 complaints, Ex. 027), and Metro Codes and Regulations docketed seven face-mask violations against business premises before the Code Enforcement Board in December 2020 (Ex. 018). Louisville's April 7, 2020 prohibition of drive-in worship was enjoined by the Western District of Kentucky on April 11, 2020 (Ex. 006). In the third quarter of 2021 the local layer re-tightened: Louisville Metro Government required masks in every city building and vehicle 'regardless of vaccination status' from August 2, 2021 (Ex. 017); the Metro Council on August 12, 2021 made City Hall masking, virtual meetings and public admission the Council President's compulsory call and authorized virtual participation (Exs. 005, 016); Jefferson County Public Schools and Fayette County Public Schools required masks of every student, employee and visitor from August 11, 2021, with quarantines (Ex. 028; 046, 048); Louisville entered its red alert level on August 10, 2021 and remained there through September (Ex. 041); Metro Parks cancelled its 2021 events (Ex. 029); and Lexington directed the public to mask indoors and opened school testing sites on August 24, 2021 (Ex. 037). Louisville Ordinances 057-2020 and 085-2021 and Lexington Ordinance 18-2021 were in force on every day of the third quarter of 2021. Kentucky never barred these local instruments; the 2021 fight over emergency powers (HB 1, SB 1, SB 2 and HJR 77 of the 2021 Regular Session, enjoined March 2021, sustained in Cameron v. Beshear, Ky. Aug. 21, 2021; Beshear v. Acree, Ky. Nov. 12, 2020) concerned the Governor's orders, and the Special Session extended them to January 15, 2022 while returning school masking to the districts.

The State and the local orders

None as to the instruments recorded here. Kentucky's local governments and local boards of health (KRS ch. 212) retained their powers throughout; neither Louisville nor Lexington adopted a general local business-closure or community-wide mask ordinance of its own, so the 2021 statutes limiting the Governor's emergency powers (HB 1, SB 1, SB 2, HJR 77 of the 2021 Regular Session; enjoined by the Franklin Circuit Court in March 2021; sustained in Cameron v. Beshear (Ky. Aug. 21, 2021)) displaced no local order. Beshear v. Acree (Ky. Nov. 12, 2020) sustained the Governor's 2020 orders. The Special Session's HJR 1 (Acts ch. 1, Sept. 7, 2021) extended the State's COVID-19 executive actions to Jan. 15, 2022; SB 1 (Acts ch. 4, Sept. 9, 2021, veto overridden) nullified 702 KAR 1:195E and 902 KAR 2:213E and directed each school district to adopt its own COVID-19 operations plan, leaving the JCPS and FCPS mask rules in place as district rules; SB 2 (Acts ch. 5, Sept. 10, 2021, veto overridden) addressed COVID-19 emergency actions (KY State file). The one local instrument enjoined was Louisville's April 7, 2020 drive-in-worship prohibition (On Fire Christian Center, Inc. v. Fischer, No. 3:20-cv-264-JRW, W.D. Ky. Apr. 11, 2020, Ex. MET-SDF-006; settled Apr. 21, 2020).
