The record in brief

ScopeCity of Chicago (Commissioner of Health / Chicago Department of Public Health orders under Municipal Code of Chicago ch. 2-112; Mayor's advisories and executive orders; Office of the Mayor reopening guidelines incorporated by reference), suburban Cook County (Cook County Department of Public Health mitigation orders under 20 ILCS 2305, 20 ILCS 2310 and Cook County Code ch. 38 art. II), the Village of Oak Park Department of Public Health (an independent certified local health department inside Cook County), the Circuit Court of Cook County (general administrative orders), and the Chicago Transit Authority and Metra (transit operating rules). Statewide instruments are cited by name and date only.

Chicago and Cook County ran a continuous, layered regime of local orders from March 16, 2020 through and beyond September 30, 2021, sitting on top of the Governor's statewide orders and, from June 5, 2020 onward, expressly invoking the Governor's affirmation that 'a local government body may enact provisions that are stricter than those in the Executive Order' (recited in every Chicago Department of Public Health (CDPH) reopening order). 2020 Q2 (with the March 13-31 run-up): the Village of Oak Park closed restaurants and liquor establishments to on-premises consumption at 9:00 p.m. on March 16, 2020 (Ex. MET-CHI-043) and issued a full shelter-in-place order on March 18, effective 12:01 a.m. March 20, 2020, one day before the Governor's stay-at-home order took effect (Ex. MET-CHI-044, -045); CDPH ordered symptomatic persons to shelter at home (Order 2020-1, Mar. 18, 2020, Ex. MET-CHI-001), ordered every Chicago hospital to postpone elective surgeries and medical procedures, restrict visitors and screen employees each shift (Order 2020-2, Mar. 19, 2020, Ex. MET-CHI-002), closed the entire Lakefront, the Riverwalk and the 606 and banned gatherings of more than ten (Order 2020-3, Mar. 26, 2020, Ex. MET-CHI-005, amended May 1 and May 29, 2020, Ex. MET-CHI-006, -007), cut off all liquor sales at 9:00 p.m. (Order 2020-5, Apr. 8, 2020, Ex. MET-CHI-008), and compelled short-term-rental platforms to report every reservation and to make renters acknowledge the stay-at-home order (Order 2020-7, May 8, 2020, Ex. MET-CHI-012). The Circuit Court of Cook County moved to emergency procedures from March 13-16, 2020 (Ex. MET-CHI-057, -058, -059). Chicago entered Phase III on its own timetable under Order 2020-9 (June 5, 2020, Ex. MET-CHI-013): masks in public, capacity limits set by the Mayor's guidelines, non-essential retail at 25 percent, bars without food licenses closed, Lakefront still closed. 2020 Q3: Phase IV from June 26, 2020, re-tightened July 24, 2020 (no indoor liquor service without a retail food license; capacity per the Gradually Resume Guidelines; employee self-screening every shift, Ex. MET-CHI-014); the Emergency Travel Order (Order 2020-10, issued July 2, effective July 6, 2020, Ex. MET-CHI-019) imposed a 14-day quarantine on every person entering Chicago from a State above 15 daily cases per 100,000; the CTA capped riders at about 15 per bus and 22 per rail car and required rear-door boarding (Ex. MET-CHI-050); Chancery Division foreclosure proceedings and sales were stayed to October 17, 2020 (Ex. MET-CHI-054). 2020 Q4: Chicago imposed a non-essential business curfew (10:00 p.m.-6:00 a.m. from Oct. 23, 2020; 11:00 p.m. from Oct. 30, 2020, Ex. MET-CHI-021, -022) and tightened liquor hours again (Ex. MET-CHI-009); every Title 4 licensee was ordered to report any COVID-19 suspension of operations (Ex. MET-CHI-004, -028); the State suspended indoor dining in Chicago (Region 11) from October 30, 2020 and in suburban Cook (Region 10) from October 28, 2020, and the Cook County Department of Public Health (CCDPH) issued its first enforcement order on November 6, 2020 (restaurants and bars closed 11:00 p.m.-6:00 a.m., no indoor consumption, meetings capped at 25, casinos at 25 percent, Ex. MET-CHI-033); the Mayor's Stay-at-Home Advisory of November 12, 2020 (effective Nov. 16) capped meetings and social events at ten persons and was amended November 20, 2020 to close event venues to all gatherings and cap retail at 25 percent under Tier 3 (Ex. What remained in force

In Chicago after June 11, 2021: Order 2020-9 (Eighth Amended) itself, which kept masks and distancing mandatory for every individual not fully vaccinated in any public place (Sec. 2), kept every business under duties to ensure unvaccinated employees and customers mask and distance, to supply sanitation, to have every employee self-screen for symptoms at the start of every shift and to observe any capacity figure in the Gradually Resume Guidelines (Sec. 3), and kept masks mandatory for everyone on public transportation and in transportation hubs, congregate facilities and health-care settings (Sec. 5); Order 2020-1 (isolation of symptomatic persons, Mar. 18, 2020); Order 2020-2 (Fourth Amended, Dec. 16, 2020: hospital PPE, visitor and screening protocols; reporting of any COVID-19 suspension of operations by any Title 4 licensee); Order 2020-4 (Amended, Jan. 15, 2021: hospital data sharing); Order 2020-5 (Ninth Amended, May 18, 2021: late-hour liquor premises restricted to fully vaccinated patrons during late hours; package-goods liquor sales cease at 11:00 p.m.); then Order 2021-1 (masks indoors for everyone, Aug. 20, 2021). In suburban Cook: CCDPH Order 2021-9 (no business limits, June 11-Aug. 22, 2021), then Order 2021-10 (masks indoors for everyone, effective Aug. 23, 2021). Statewide: the Gubernatorial Disaster Proclamation renewals; EO 2021-15 (July 23, 2021); the Aug. 4, 2021 school-mask order; the Aug. 26, 2021 statewide indoor mask order (effective Aug. 30, 2021) with vaccination-or-testing rules for health-care, school and higher-education personnel. Federal: the CDC conveyance mask order and TSA security directives, enforced on the CTA and Metra.

The State and the local orders

Illinois never preempted or barred Chicago or Cook County COVID-19 orders. The opposite occurred: every CDPH reopening order from June 5, 2020 through August 20, 2021 recites that the Governor, in Executive Orders 2020-38 (filed May 29, 2020), 2020-43 (June 26, 2020), 2021-10 (May 17, 2021), 2021-11 (May 28, 2021) and 2021-15 (July 23, 2021), 'affirmed that a local government body may enact provisions that are stricter than those in the Executive Order,' and each Chicago order provides that where it conflicts with a State order 'the more restrictive alternative applies' (Order 2020-9 Sixth Amended Sec. 8; Eighth Amended Sec. 9; Order 2021-1 Sec. 6). CCDPH orders recite that they act under authority delegated by the Illinois Department of Public Health (20 ILCS 2305; 20 ILCS 2310) and Cook County Code ch. 38, with enforcement by any law enforcement officer under Sec. 38-33(b) and penalties under Sec. 38-38. Oak Park orders rest on Village Resolution 20-120 (Mar. 13, 2020) and Ordinance 21-8 (Jan. 19, 2021), extended by Ordinance 21-47 through November 15, 2021, with Class A misdemeanor exposure under 720 ILCS 5/12-5 and 20 ILCS 2305/2(k).
