The record in brief

ScopeCounty and municipal instruments of the Charlotte metropolitan area (Mecklenburg County, City of Charlotte, the six Mecklenburg towns) and of the Research Triangle (Wake County, City of Raleigh and the Wake towns; Durham County and City of Durham; Orange County noted), March 2020 through September 30, 2021, with the transit agencies (CATS, GoTriangle, GoRaleigh, GoDurham). Statewide instruments (EO 116, 117, 118, 120, 121, 131, 135, 138, 141, 147, 151, 153, 155, 163, 169, 170, 176, 180, 181, 188, 189, 195, 204, 209, 215, 220, 224, 229; S.L. 2021-130; the Chief Justice's emergency directives) are cited by name and date only.

The Charlotte and Raleigh-Durham metros carried a local layer of orders that began before, ran alongside, and in places outlasted the State's regime. MECKLENBURG AND CHARLOTTE. On March 13, 2020 at 1800 hours the Chair of the Board of County Commissioners and the Mayor of Charlotte, joined by the six towns (Cornelius, Davidson, Huntersville, Matthews, Mint Hill, Pineville), proclaimed a Joint State of Emergency under G.S. 166A-19.22 that restricted access to public streets and provided that 'the operation of business activity, entertainment, events, or other places of public mass gatherings, is reasonably and necessarily prohibited or restricted... except in areas or times designated by the Mecklenburg County Health Department' (Ex. MET-CLT-008). The Health Director's Order for Prohibiting Mass Gatherings (issued March 17, effective 8 a.m. March 16, 2020 through April 12) banned gatherings of 50 or more and ordered gyms, fitness centers, health clubs and theaters to 'cease operations immediately' (Ex. MET-CLT-020). The Revised Joint Proclamation of March 24, 2020 (the county Stay at Home Order) took effect at 8:00 a.m. on March 26, 2020: all individuals 'restricted to shelter at their places of residence'; 'Non-essential business and operations must cease'; all gatherings of more than 10 prohibited; places of public amusement closed; all non-essential travel prohibited; nursing-home visitation restricted; violations a Class 2 misdemeanor under G.S. 14-288.20A; valid through April 16, 2020 (Ex. MET-CLT-018). The county extended it to April 29, 2020 and then, lacking Huntersville's consent to a further joint extension, transitioned to the Governor's EO 121/135 through May 8 (WFAE, Apr. 23 and Apr. 28, 2020). In Phase 2 the county went beyond the State: the Amended Joint Proclamation of July 7, 2020 adopted EO 147 and added a face-covering requirement in all County, City and Town buildings and 'in any other indoor or outdoor situation in which people cannot maintain the CDC recommended social distance' (Ex. MET-CLT-011); the Second Revised and Amended Joint Proclamation of July 23, 2020 closed restaurants and private clubs to on-site consumption from 11 p.m. to 5 a.m., barred alcohol sales for on-site consumption from 11 p.m. to 7 a.m., forbade sitting or standing at bars and shared game equipment, and capped outdoor gatherings at 25, through 5 p.m. August 7, 2020 (Ex. MET-CLT-022; Mint Hill and Pineville amendments, Ex. MET-CLT-013, -014). The Health Director's Order of Abatement of Imminent Hazard closed every United House of Prayer facility from 10:00 a.m. October 24, 2020 (Ex. MET-CLT-009), and her Public Health Directives of January 12 and January 29, 2021 directed residents to 'Stay home. Only leave your home for essential activities,' to 'Utilize full-virtual options for work,' to remain home 10 p.m. to 5 a.m., and to cap any gathering at 25 outdoors, through February 28, 2021 (Ex. MET-CLT-005, -012). The county's emergency proclamation was revised on June 1, 2021 to track EO 215 while keeping face coverings in county facilities for the unvaccinated (Ex. MET-CLT-037). Q3 2021: on August 18, 2021 the Chair and the Mayor adopted the Third Revised and Amended Joint Proclamation requiring face coverings 'in all indoor public settings within the City of Charlotte, the unincorporated areas of Mecklenburg County, regardless of a person's vaccination status,' effective 5 p.m. that day through September 1, 2021 (Ex. MET-CLT-023, -024, -010), and the Board of Commissioners, sitting as the board of health under G.S. 153A-77 and 130A-39, adopted the Board of Health Rule Requiring Face Coverings to be Worn in All Public Places, applicable 'throughout Mecklenburg County... including... all Cities and Towns' (Ex. MET-CLT-001, -025), published August 20 (Ex. MET-CLT-002) and effective August 31, 2021 (Ex. MET-CLT-027); the rule was revised September 8-12, 2021 (Ex. MET-CLT-004, -015, -026, -003) and remained in force through February 26, 2022. County employees were ordered masked in county buildings from August 3, 2021, to disclose vaccination status by September 1 and, if unvaccinated, to test weekly from September 7, 2021 (WFAE). CATS suspended fares, moved to rear-door boarding and a reduced schedule in March 2020 and required face masks (Ex. MET-CLT-073, -074). WAKE AND RALEIGH. Wake County's Chair declared a state of emergency March 13, 2020, issued a Proclamation of Emergency Restrictions on March 22, 2020 closing gyms, salons, spas, massage and tattoo establishments and banning gatherings of 50 or more (Ex. MET-CLT-050), and signed the county Stay-at-Home Proclamation on March 26, 2020, effective 5 p.m. March 27 through April 17 (Ex. MET-CLT-051); a new proclamation extended it to April 30, 2020 (Ex. MET-CLT-052, -053). The City of Raleigh declared its emergency March 13, 2020, required face coverings from 4:00 p.m. June 19, 2020 (Ex. MET-CLT-041), barred alcohol sales 11 p.m. to 7 a.m. from 4:00 p.m. July 22, 2020 (Ex. MET-CLT-043), terminated those two orders at 5 p.m. February 26, 2021 while continuing the emergency (Ex. MET-CLT-044), and reimposed indoor face coverings at 5:00 p.m. August 13, 2021 (Ex. MET-CLT-045) through 5 p.m. February 25, 2022 (Ex. MET-CLT-046). Wake County's countywide indoor mask requirement was in force by August 16, 2021 (Ex. MET-CLT-054) and ended February 25, 2022; Cary's mayor ordered masks from 5 p.m. August 18, 2021; Knightdale required masks from June 21, 2020. GoRaleigh and GoTriangle suspended fares and went to rear-door boarding March 23, 2020, cut to weekend schedules March 30, 2020, and required face coverings from June 22, 2020 (Ex. MET-CLT-070 to -072). DURHAM. Mayor Schewel's Stay-at-Home Order took effect 6 p.m. March 26, 2020 (gatherings of 10 or more prohibited; non-essential residents barred from streets except for essential activities), Durham County's parallel order followed March 27, the county required face coverings from April 2020 (Ex. MET-CLT-062), the local order ran through June 1, 2020 and was succeeded by a Safer at Home Order stricter than the State's (outdoor gatherings capped at 10; face coverings continued) (Ex. MET-CLT-063), amended serially by the County Chair and adopted by the Mayor under G.S. 166A-19.22(b)(2) (10th Amendment Sept. 4, 2020; 11th Amendment Oct. 3, 2020; Ex. MET-CLT-060, -061). Durham County and the City reimposed indoor face coverings at 5 p.m. August 9, 2021 (WUNC). GoDurham suspended fares and required face coverings (Ex. MET-CLT-075). ORANGE COUNTY (Chapel Hill, Carrboro, Hillsborough): stay-at-home from 6 p.m. March 27, 2020; face coverings from 5 p.m. June 12, 2020 with the emergency extended through August 31, 2020 (Ex. MET-CLT-030); indoor masks reinstated 5 p.m. August 11, 2021 (Ex. MET-CLT-031) through March 7, 2022 (Ex. MET-CLT-032). PREEMPTION: none. EO 121 sec. 4(A), EO 215 sec. 5.3(a) and EO 224 sec. 2.4(a) expressly preserved more restrictive local orders; no statute barred county or city mask orders through September 30, 2021.

End of general restrictions

2021-06-01 (Mecklenburg); 2021-02-26 (Raleigh); statewide EO 215 of May 14, 2021 governed the metros' general capacity, gathering and mask rules thereafter

Instrument Local general business restrictions ended in steps: Mecklenburg's county stay-at-home order expired April 29, 2020 (State EO 121/135 governed to May 8, 2020); the Mecklenburg Second Revised and Amended Joint Proclamation (bar and late-hours restrictions) ran to 5 p.m. Aug. 7, 2020; Raleigh's Declaration of End of City COVID-19 Orders terminated the city face-covering and alcohol orders at 5 p.m. Feb. 26, 2021 (Ex. MET-CLT-044); Mecklenburg's Second Revised and Amended Proclamation of June 1, 2021 conformed county restrictions to EO 215 (Ex. MET-CLT-037); Durham's Safer at Home amendments tracked the State's phases through 2020-21.

What remained in force

Every local state of emergency (Mecklenburg-Charlotte joint proclamation of Mar. 13, 2020; Raleigh's of Mar. 13, 2020; Wake's of Mar. 13, 2020; Durham's and Orange's) remained in force through Sept. 30, 2021 and beyond; face coverings in county facilities for the unvaccinated (Mecklenburg, June 1, 2021); transit fare suspensions and rear-door boarding (GoTriangle, GoRaleigh, GoDurham through 2021); the CDC conveyance mask order on every bus and train; then the Aug. 2021 reinstatements: Durham (Aug. 9), Orange (Aug. 11), Raleigh (Aug. 13), Wake County (by Aug. 16), Cary (Aug. 18), Charlotte and unincorporated Mecklenburg (Aug. 18), all of Mecklenburg including the six towns (Aug. 31, 2021 by Board of Health Rule).

The State and the local orders

None in North Carolina through Sept. 30, 2021. EO 121 sec. 4(A) (Mar. 27, 2020): 'nothing herein is intended to limit or prohibit counties and cities in North Carolina from enacting ordinances and issuing state of emergency declarations which impose greater restrictions or prohibitions'; the same reservation appears in EO 215 sec. 5.3(a) (May 14, 2021) and EO 224 sec. 2.4(a) (July 29, 2021). Two narrow exceptions: EO 131 sec. 1 (Apr. 9, 2020) preempted local declarations imposing stricter retail occupancy limits than the State's, and EO 153 sec. 3(B) (July 28, 2020) barred local governments from setting more permissive alcohol-sale hours. G.S. 166A-19.30(c)(1) allowed the Governor to rescind local prohibitions; no order did. S.L. 2021-130 sec. 10 (Aug. 30, 2021) required school boards to adopt a face-covering policy and vote on it monthly; it did not bar local mask orders. The Huntersville mayor's August 2021 challenge to the Board of Health Rule under G.S. 130A-39 produced no injunction; the rule applied in the six towns from Aug. 31, 2021 (WFAE, Aug. 26, 2021). Mecklenburg's stay-at-home extension beyond April 29, 2020 failed only because a joint proclamation under G.S. 166A-19.22(c) requires each town's consent and Huntersville withheld it; the State's EO 135 then governed to May 8, 2020.
