The record in brief

ScopeWashington, D.C. suburbs: Montgomery and Prince George's Counties, Maryland; Fairfax, Arlington, Loudoun and Prince William Counties and the City of Alexandria, Virginia; the Washington Metropolitan Area Transit Authority (WMATA) as the region's transit agency. Maryland and Virginia statewide orders are cited by name and date only.

The Washington suburbs ran two different local regimes on top of two different State regimes. In Maryland the Governor's emergency orders expressly authorized the counties to be more restrictive, and Montgomery County and Prince George's County used that authority continuously from May 2020 through May 2021, then legislated their own indoor face-covering orders in August 2021 under independent county authority. In Virginia the Dillon Rule left the counties and Alexandria without power to close businesses or mask the public; their instruments were emergency declarations, continuity-of-government and outdoor-dining emergency ordinances, facility closures, a joint demand to the Governor that produced the Northern Virginia Phase Zero delay, Arlington's sidewalk physical-distancing emergency ordinance, and the circuit courts' own orders, which ran through the third quarter of 2021. 2020 Q2: on April 1, 2020 both States were under stay-at-home orders (Maryland Order 20-03-30-01; Virginia EO 55); Prince George's County had declared its own emergency by EO 6-2020 (Mar. 16, 2020) and, by EO 7-2020 (Apr. 13, 2020), required masks in grocery stores, pharmacies, large chain retail and on TheBus from April 15, 2020, weeks before the State; TheBus had suspended six routes and cut two more from March 19, 2020; Fairfax, Arlington and Loudoun had declared local emergencies (Mar. 13-17, 2020), closed county buildings to the public (Fairfax from 5 p.m. Mar. 27, 2020) and their circuit courts had suspended civil and criminal trials (Fairfax and Alexandria from Mar. 17, 2020). When the Governor of Maryland lifted the statewide stay-at-home at 5 p.m. on May 15, 2020, Montgomery County Executive Order 067-20 (May 15, 2020, approved by Council Resolution 19-456 the same day) kept the stay-at-home and every closure in force in the county until the Health Officer's criteria were met; Prince George's EO 8-2020 (May 14, 2020) did the same. Montgomery entered Phase 1 by EO 070-20 on June 1, 2020 (retail curbside only, restaurants outdoor seating only, gatherings over 10 prohibited, theaters, gyms and malls closed) and lifted its stay-at-home only at 5 p.m. on June 19, 2020 by EO 082-20 (Phase 2: gatherings over 50 prohibited; indoor dining and offices reopened under conditions; theaters closed; the Health Officer's June 18, 2020 face-covering order for all residents over two in public). Northern Virginia stayed in Phase Zero until 11:59 p.m. May 28, 2020 at the five localities' written request of May 10, 2020 (the Governor's EO 62), and entered Phase Two a week after the rest of the Commonwealth (June 12, 2020); Fairfax adopted an emergency ordinance on May 28, 2020 to make outdoor dining and outdoor fitness lawful without permits. 2020 Q3: Montgomery's amended and restated local orders (EO 087-20, Aug. 5; 098-20, Aug. 24; 114-20, Sept. 22; 117-20, Sept. 29, 2020) held gatherings at 50, indoor dining and retail at 50 percent, alcohol service to 10 p.m., theaters closed, face coverings for everyone over two, with fines up to $20,000; the Health Officer closed all nonpublic schools to in-person instruction (July 31 and Aug. 5, 2020) until the Governor's amended order of August 3, 2020 (No. 20-08-03-01) and the Secretary of Health's direction forced the rescission on August 7, 2020. Prince George's Health Officer ordered face coverings in every indoor retail and business establishment and imposed employer sanitation, hand-washing and PPE duties (Aug. 4, 2020, superseding a July 31 large-gatherings order). Fairfax Circuit Court required face coverings of every person entering the courthouse (May 18, 2020) and screened every entrant (Apr. 27, 2020). 2020 Q4: Montgomery tightened on November 10, 2020 (EO 122-20 AM: gatherings 25; retail one patron per 200 square feet or 25 percent; indoor dining 25 percent), again on November 24 (amended Health Officer directive on face coverings and gatherings) and on December 15, 2020 (EO 139-20 AM2: indoor gatherings 10, outdoor 25; indoor dining suspended, outdoor seating 6 a.m. to 10 p.m., carry-out; 25 percent occupancy everywhere else). Prince George's Health Officer's directive of November 12, 2020 (effective Nov. 15, 2020, 5 p.m.) cut indoor dining to 25 percent and gatherings to 10 indoors and 25 outdoors, and EO 27-2020 (Dec. 15, 2020) closed indoor dining. Virginia's EO 72 (effective Dec. 14, 2020) added a midnight-to-5 a.m. curfew, a ten-person gathering cap and universal masks statewide. 2021 Q1: the Montgomery orders continued (EO 19-21 AM, Feb. 14, 2021, restored indoor dining at 25 percent with a ninety-minute limit and a 10 p.m. alcohol cutoff); when the Governor lifted statewide capacity limits at 5 p.m. on March 12, 2021, the County Council sitting as the Board of Health adopted, the same afternoon and effective the same hour, a Board of Health Regulation under Md. Code Health-Gen. § 3-202(d) that kept the county's face-covering, gathering (50 outdoor, 25 indoor) and 25 percent capacity rules in force, stepping to 50 percent on March 26, 2021 (Res. 19-760, amended Mar. 19 and Mar. 26). 2021 Q2: the regulation was amended on April 13, April 20 and April 27, 2021 (businesses and indoor dining at 50 percent) and on May 18, 2021 (75 percent; indoor gatherings 250; masks for all on transit, in health care and schools, and for the unvaccinated indoors), and terminated itself at 6:00 a.m. on May 28, 2021, from which date the county followed State rules; Prince George's aligned with the State by EO 14-2021 (May 26, 2021) and the Chief Administrative Officer's memorandum of May 28, 2021. Virginia lifted its capacity, gathering and mask rules on May 28, 2021 (EO 79) and its emergency expired June 30, 2021; Maryland's emergency ended July 1, 2021 with a grace period to August 15, 2021. 2021 Q3: the Delta wave brought new local orders. Montgomery's Board of Health Regulation of August 5, 2021 (Res. 19-975, effective Aug. 7, 2021, 12:00 a.m.) required every person over two to wear a face covering indoors at any location accessible to the public whenever the Health Officer certified substantial transmission (certified Aug. 5, 2021; high transmission Sept. 1, 2021), and it remained in force through September 30, 2021 and beyond. Prince George's EO 18-2021 (Aug. 5, 2021) required indoor face coverings for all persons over five, EO 21-2021 (Sept. 30, 2021) extended it to everyone over two, and EO 19-2021 imposed vaccination-or-weekly-testing on county employees, volunteers and contractors. In Virginia the five health directors jointly recommended indoor masks for all on August 3, 2021, the Alexandria Circuit Court ordered masks for every person entering the courthouse effective August 2, 2021, and the Fairfax Circuit Court reinstated masks for entry to the Judicial Complex and all public areas on August 4, 2021 (its third amendment to the May 18, 2020 order). Federal transit mask orders governed WMATA throughout the quarter.

What remained in force

After May 28, 2021 both Maryland counties followed State and Maryland Department of Health requirements (transit, health-care and school masking; the State emergency to July 1, 2021 and its grace period to Aug. 15, 2021). Prince George's kept face coverings for employees on duty at Corrections and the County Courthouse. Fairfax Circuit Court's face-covering order remained in force as amended (June 10 and July 6, 2021), then was expanded Aug. 4, 2021. New local indoor face-covering orders took effect Aug. 7, 2021 (Montgomery) and Aug. 5, 2021 (Prince George's); court mask orders in Alexandria (Aug. 2, 2021) and Fairfax (Aug. 4, 2021); federal transit mask orders on WMATA throughout.

The State and the local orders

Maryland never preempted the counties' COVID-19 business orders; the reverse is true. Each Governor's order recited in the Montgomery County executive orders (Nos. 20-05-13-01, 20-05-27-01, 20-09-18-01, 20-10-16-02 and 20-11-17-01) 'gave Maryland counties the authority to continue to impose limitations on business and personal activities that were more restrictive' than the State's (Ex. MET-DCM-001, -009, -011, -013, verbatim recitals). The one preemptive act was narrow: after the Montgomery County Health Officer barred in-person instruction at all nonpublic schools (July 31, 2020, reissued Aug. 5, 2020 under Md. Code Health-Gen. § 18-208 and COMAR 10.06.01.06), the Governor's amended order of August 3, 2020 (No. 20-08-03-01, recited in Ex. MET-DCM-008) and the Secretary of Health's memorandum of August 6, 2020 produced the rescission of August 7, 2020 (Ex. MET-DCM-005, -006). When the State ended its capacity limits (Mar. 12, 2021) and its emergency (July 1, 2021, grace period to Aug. 15, 2021), the counties continued under independent authority: the Montgomery County Council sitting as the Board of Health under Md. Code Health-Gen. § 3-202(d) (Ex. MET-DCM-015, -023) and the Prince George's County Executive under Md. Code Pub. Safety § 14-111 and Subtitle 6 of the County Code (Ex. MET-DCM-033, -047). No court enjoined any of these local instruments. Virginia is a Dillon Rule State: no Northern Virginia locality closed businesses, capped capacity or masked the public by its own order; the Governor's executive orders did that statewide, and the localities acted through declarations of local emergency under Va. Code §§ 44-146.16 and 44-146.21 (Ex. MET-DCM-093), emergency ordinances under Va. Code § 15.2-1413 (Ex. MET-DCM-094, -095), facility closures, the May 10, 2020 joint request that produced the Northern Virginia Phase Zero delay (Ex. MET-DCM-061), Arlington's sidewalk physical-distancing emergency ordinance (enforced from Aug. 28, 2020; lapsed Sept. 2020) (Ex. MET-DCM-083), and the circuit courts' orders under the Supreme Court of Virginia's judicial-emergency orders (Ex. MET-DCM-040 to -044, -050 to -052). In the third quarter of 2021 the Virginia localities issued recommendations (Ex. MET-DCM-062) and court orders, not public mask mandates.
