The record in brief

ScopeCounty and municipal instruments of the Las Vegas and Reno metropolitan areas, March 2020 through September 30, 2021: Clark County Board of County Commissioners and County Manager; the Cities of Las Vegas, North Las Vegas and Henderson; the Eighth Judicial District Court (Clark County); Washoe County Board of County Commissioners and County Manager; the Washoe County Health District (District Health Officer); the City of Reno; the Clark County and Washoe County School Districts.

The Las Vegas and Reno metros ran on a State-led regime with a dense local layer beneath it, and that local layer produced instruments with force of law in every one of the six quarters. 2020 Q2 (with the March 13-31, 2020 run-up): the Clark County Manager declared a state of emergency on March 15, 2020 (MET-LAS-002, -026); the City of North Las Vegas declared one the same day (ratified by Resolution No. 2644 on April 1, 2020; MET-LAS-021); the Mayor of Las Vegas proclaimed one over the weekend of March 14-15 and the City Council ratified it and activated the City's Emergency Management Plan on March 18, 2020 (MET-LAS-020); Reno's Mayor declared an emergency under RMC 8.34.060 on March 13, 2020 and on March 16, 2020 announced an order limiting or prohibiting dine-in restaurant service, bars, nightclubs and gyms, which the Governor's statewide closure (announced March 17; Directive 003 of March 20, effective 11:59 p.m., through April 16, 2020) superseded (MET-LAS-023, -024, -025); Washoe County declared an emergency on March 16, 2020 (MET-LAS-030), and on March 21, 2020 the Washoe County Sheriff and the Reno and Sparks police chiefs published the regional enforcement notice for the Governor's closure of non-essential businesses (MET-LAS-031). Clark County made the State's directives enforceable locally by two emergency ordinances: the March 20, 2020 ordinance (ch. 6.04; enforcement by the Las Vegas Metropolitan Police Department and County personnel of the Governor's closure of non-essential businesses; MET-LAS-001) and the April 21, 2020 ordinance adding Clark County Code 3.04.065, under which violation of an emergency order, directive or regulation of the Governor, Board, Sheriff or County Manager 'is punishable by suspension or revocation of a business license, by imposition of an administrative penalty of up to $1000 per violation per day, or as a criminal misdemeanor' (MET-LAS-026, effective April 21, 2020). North Las Vegas did the same by Emergency Ordinance No. 3024 (April 8, 2020; MET-LAS-022). The Eighth Judicial District Court suspended all jury trials and moved non-essential hearings to video or telephone from March 16, 2020 (AO 20-01, MET-LAS-010), stayed civil discovery, in-person depositions, settlement conferences and writs of execution and garnishment (AO 20-09, MET-LAS-011), continued the suspension for the life of the Governor's emergency plus thirty days (AO 20-13, MET-LAS-012), imposed mandatory face coverings in every court facility (AO 20-16, May 21, 2020, MET-LAS-013) and, on June 1, 2020, entered the Phase 2 all-operations order that kept the Clerk's Offices closed to in-person filing, capped in-person court meetings at 50, kept the traffic counters closed, required alternative-means appearances and masks, and stayed civil trials under NRCP 41(e) (AO 20-17, MET-LAS-014). 2020 Q3: the Clark ordinances, the local emergencies and AO 20-17 remained in force; the Court had to designate the Las Vegas Convention Center as a temporary courtroom because Directive 021 section 10's gathering cap could not accommodate a bench trial with more than 50 participants (AO 20-18, July 8, 2020, MET-LAS-042); Washoe County's Phase 2 county-facility protocols (temperature checks, entry refusals, virtual public meetings; MET-LAS-038) continued. 2020 Q4: the Washoe County District Health Officer refused to permit any gathering above 250 for thirty days from October 8, 2020 (MET-LAS-032); Washoe County's action plan cutting the public-gathering limit from 250 to 50 (or 50 percent occupancy) took effect at 11:59 p.m. on November 5, 2020 (MET-LAS-033); Clark County required its employees to wear face coverings at all times (recited in MET-LAS-015, -017, -019); and the District Court's AO 20-24 (November 24, 2020) required all appearances by alternative means, suspended jury trials and grand juries and in-person meetings, closed the Clerk's Offices to in-person filing and barred in-person depositions through January 11, 2021 (MET-LAS-015). 2021 Q1: AO 21-01 (January 12, 2021) extended the pause provisions to February 15, 2021, resuming jury trials only on February 1 (MET-LAS-016); AO 21-03 (March 11, 2021) kept alternative-means appearances mandatory for everything but trials, masks universal, in-person court meetings capped at 100, the Clerk's Offices on limited afternoon hours from March 15, and the traffic counters closed (MET-LAS-017). 2021 Q2: the State delegated mitigation authority to counties with approved plans effective May 1, 2021 (Directive 044); Clark County's Local Mitigation and Enforcement Plan (adopted April 20, approved by the State Task Force April 27, effective May 1) set capacity at 80 percent of fire code and distancing at three feet and required approved Large Gathering Plans for events above 250 (MET-LAS-003, -004); Washoe County's plan (approved April 21 and, with the required endorsements, May 3, 2021) ran May 3-31 with masks, six-foot distancing, tables of ten, bar groups of four, closed self-service buffets and Health District approval for events above 500 (MET-LAS-034, -035, -036). Clark County deleted its plan 'in its entirety' effective June 1, 2021 and let vaccinated persons unmask from May 19 (MET-LAS-005); Washoe's distancing ended June 1, 2021. The District Court's AO 21-04 (June 4, 2021) kept masks mandatory for the unvaccinated everywhere and for everyone in courtrooms and jury assembly, kept alternative-means appearances preferred and the NRCP 41(e) stay through July 1, 2021 (MET-LAS-018). 2021 Q3: the Clark County emergency declaration, AO 21-04 and then AO 21-05 (July 19, 2021: face coverings 'must be worn regardless of vaccination status' in every court facility; MET-LAS-019) were in force; Clark County reinstated masks for county employees in county facilities on July 19 and, at an Emergency Meeting on July 20, 2021, ordered every employee of every business in indoor public spaces, in the incorporated cities and the unincorporated county, to wear a mask from midnight July 22, 2021 through at least August 17, 2021, with signage requirements for businesses (MET-LAS-006, -007, -009); the Governor's Directive 047 (July 27, effective July 30, 2021) then reimposed universal indoor masking in Clark and Washoe Counties as counties of substantial or high transmission (local applicability recorded in MET-LAS-037); Clark County took up an employee vaccination-or-testing policy on August 3, 2021 (MET-LAS-008). No local instrument of general business closure or capacity limitation was in force in Q3 2021; the instruments in force were masks (court, county, then State), the emergencies, the court's operating restrictions and the State's school and transit layers.

End of general restrictions

Instrument Clark County Board of County Commissioners, revision of the Local COVID-19 Regional Mitigation and Enforcement Plan, item 62 of May 18, 2021 (MET-LAS-005): 'Effective June 1, 2021 Clark County will delete in its entirety the plan set and executed on May 1, 2021 and return to pre-pandemic guidelines. This means that restrictions involving capacity limits, large gatherings, dancing, etc. will no longer be in effect.' Washoe County: the local-authority plan measures ran May 3-31, 2021 and provided 'No social distance requirements' from June 1, 2021 (MET-LAS-035).

What remained in force

The statewide mask requirement (Directive 024 as modified for vaccinated persons in May 2021, then Directive 047 from July 30, 2021 in Clark and Washoe Counties); the Clark County emergency declaration of March 15, 2020 (ended 2022; MET-LAS-002); the Eighth Judicial District Court's AO 21-04 (June 4, 2021) and AO 21-05 (July 19, 2021), with masks in court facilities, alternative-means appearances preferred, jury operations under the COVID-19 Jury Trial Plan and the NRCP 41(e) stay through July 1, 2021; Clark County's July 20, 2021 employee mask measure (July 22 through at least August 17, 2021); the State's school directives; the federal CDC conveyance mask order on RTC transit and at Harry Reid (McCarran) and Reno-Tahoe airports (FED-A).

The State and the local orders

Nevada did not bar local COVID-19 orders at any time in the period. The State framework absorbed them: the Governor's Directive 003 (March 20, 2020) superseded Reno's March 16, 2020 closure order by imposing a stricter statewide closure (Reno's own staff report records that the Governor 'preempted this declaration'; MET-LAS-025); the COVID-19 Mitigation and Management Task Force framework of August-November 2020 required counties flagged for elevated transmission to submit action plans, which is how Washoe County's 50-person gathering cap of November 5, 2020 was approved (MET-LAS-033); Directive 044 (April 20-21, 2021) delegated mitigation and enforcement authority to counties with approved Local Mitigation and Enforcement Plans from May 1, 2021, while the State retained the statewide mask requirement, school requirements and Gaming Control Board regulation (MET-LAS-003, -034); and the July 19, 2021 Clark County staff report records that 'Pursuant to the Governor's directives, enforcement measures for the pandemic now rest with County officials' (MET-LAS-007).

Offices and telework

City of Las Vegas activated its Emergency Management Plan Mar. 18, 2020 (MET-LAS-020) and its employees worked remotely for nearly a year, returning Mar. 15, 2021 (Nevada Independent, not saved); Reno instructed non-critical staff to work from home and scaled departments to de minimis levels from Mar. 13, 2020 (MET-LAS-025); Washoe County ran temperature-checked, appointment-only county buildings and virtual public meetings from May 29, 2020 (MET-LAS-038); EJDC required or preferred alternative-means appearances in every order from Mar. 16, 2020 through Sept. 30, 2021 (MET-LAS-010 to -019).

Hospitals and long-term care

State and federal layers; Clark County's July 20, 2021 measure was adopted expressly to relieve hospital crowding (MET-LAS-007, -009).

Dental and elective health care

State instruments (Directive 011 and the Nevada Medical Advisory Team guidance) by name; Washoe plan applied dental-procedure protocols to head and face body-art procedures May 3-31, 2021 (MET-LAS-035).

Schools

CCSD Board of Trustees voted July 21, 2020 to open 2020-21 in full distance education from Aug. 24, 2020, reviewed every 30 days (MET-LAS-040); WCSD opened Aug. 17, 2020 with elementary in person and secondary hybrid over the District Health Officer's recommendation against reopening (MET-LAS-041); 2021-22 masking under the State's directives.
