Bexar County and the City of San Antonio ran a two-track regime under the Texas Disaster Act of 1975 (Tex. Gov't Code 418.108) and the Local Health Authority's powers under Tex. Health & Safety Code 81.082. Run-up (March 2-31, 2020): the Mayor declared a public health emergency on March 2 (Lackland evacuees) and March 13; the County Judge declared a local disaster on March 13 (Ex. 002); the Mayor's Fourth Declaration of March 18 (Ex. 003) prohibited enclosed gatherings of 50 or more from 11:59 p.m., confined food establishments to take-out, delivery and drive-through and closed bars, gyms, theaters, bowling alleys and indoor amusement; Bexar NW-01 (March 18; Ex. 004) prohibited gatherings of 50 or more for 90 days and asked landlords and lenders to suspend evictions and foreclosures; NW-02 (March 19; Ex. 005) cut the cap to 10 from March 20. Stay Home Work Safe orders of March 23 (City Emergency Order No. 5, Ex. 006; Bexar NW-03, Ex. 007) ran from 11:59 p.m. March 24 through April 9: every resident ordered to stay home, every business other than Exempted Businesses required to stop operations and close (work from home, security and IT permitted), all gatherings outside a household prohibited, restaurants take-out only. 2020 Q2: the City extended the stay-home order to April 30 by Ordinance 2020-04-09-0244 (Ex. 013); Bexar NW-05 (April 6; Ex. 011) re-issued it through April 30 under GA-14; long-term-care staff were confined to one facility from April 4 (Exs. 009-010); cloth face coverings became mandatory for everyone 10 and older from April 20 with a 25 percent occupancy cap on food and retail and a $1,000 fine (Exs. 014-015); NW-07 (April 29; Ex. 018) kept the stay-home directive through May 19 with GA-18 Reopened Services; the Sixth (Ex. 019), Seventh (Ex. 021) and Eighth (Ex. 023) Declarations and NW-08 and NW-09 (Exs. 020, 022) adopted GA-18, GA-23 and GA-26; the City Council extended the Eighth Declaration indefinitely on June 11, 2020. The quarter closed with NW-10 (June 17; Ex. 025), adopted by the City (Exs. 026-027): every commercial entity serving the public must develop, implement and post a Health and Safety Policy requiring face coverings, on pain of a $1,000 fine per violation; NW-11 and the City's second addendum added a prohibition on outdoor gatherings over 100 (Exs. 028-029); the fourth addendum added symptom screening and indoor temperature checks and adopted GA-27 and GA-28 (Ex. 030). 2020 Q3: NW-12 (July 1; Ex. 031) prohibited gatherings over 100 indoor or outdoor from July 3, capped household gatherings at 10, held restaurants at 50 percent and kept bars closed; NW-13 (July 15; Ex. 034) incorporated GA-29 and cut the gathering cap to 10; nursing-home visitation was barred July 17 (Ex. 035); the Local Health Authority closed schools to on-campus instruction until after September 7 (Ex. 036), converting to zoned recommendations August 7 (Ex. 040); foreclosure sales of July 7 and August 4 were postponed (Exs. 033, 039); NW-14, its September 4 amendment adopting the CDC eviction order, NW-15 and its September 21 amendment (restaurants 75 percent) and the City's fifth through tenth addenda carried the mandatory business policy, masks, the 10-person cap and the bar closure to September 30 (Exs. 032, 037, 041-049). 2020 Q4: NW-16 (October 15; Ex. 050) reopened bars at 50 percent from October 20 by County opt-in under GA-32; NW-17 and the eleventh addendum (November 25; Exs. 051-052) imposed a Thanksgiving curfew (10 p.m.-5 a.m., November 26-30), a 10 p.m. dine-in curfew including patios, a ban on commercial rafting and tubing and a 10 percent hospital capacity reserve; bars closed again December 10; NW-18 (December 8; Ex. 053) continued the regime until 14 days after the State emergency ends; NW-19 (December 28; Ex. 055) imposed GA-32's 50 percent occupancy limit as an area of high hospitalization. 2021 Q1: NW-19 and the eleventh and twelfth addenda governed to March 9 (Exs. 055, 052, 057); GA-34 (March 2, effective March 10) ended the statewide mandates; NW-20 (Ex. 059) and the thirteenth addendum (Ex. 060) lifted the local mask and occupancy rules while keeping the mandatory Health and Safety Policy posting for every commercial entity serving the public, county and city facility masks and screening, long-term-care staffing guidance and eviction-procedure compliance; VIA kept its mask requirement under the federal conveyance order (Ex. 058). 2021 Q2: NW-20, the thirteenth addendum, the LHA's February 2 school directive (Ex. 056), the JP courts' Fourth Order on evictions (April 7-June 30; Ex. 061) and VIA masks were in force; GA-36 (May 18) barred local mask mandates. 2021 Q3: NW-20 and the thirteenth addendum were in force July 1; GA-38 (July 29) prohibited local mask requirements and suspended 418.108 and Health & Safety Code ch. 81 subch. E to that extent; the City and County sued August 10 (Ex. 065) and obtained a TRO; the Local Health Authority ordered universal indoor masking and 14-day quarantine of unvaccinated close contacts in every K-12 public school (Ex. 066); NW-21 (effective August 11; Ex. 067) required masks in every County building, adopted the school directive countywide and continued the policy posting mandate; the fourteenth addendum (August 11; Ex. 068) ordered compliance with the CDC conveyance mask order at San Antonio International Airport and supported the City Manager's facility mask directive and the school directive; the Local Administrative Judge suspended in-person jury service August 4 (Ex. 063); the JP courts' Fifth Order (August 5; Ex. 072) governed evictions through October 3. The Supreme Court of Texas stayed the TRO August 15 (Ex. 069); the district court granted a temporary injunction August 16; the Fourth Court reinstated it August 19 (Ex. 070); the Supreme Court stayed that order August 26 (Ex. 071); the directive became an advisory October 1 (Ex. 073); the Fourth Court affirmed November 10, 2021 (Ex. 074); the Supreme Court vacated and dissolved the injunction June 30, 2023 (Exs. 075-076).

End of general restrictions
Instrument Bexar County Executive Order NW-20 (Ex. MET-SAT-059) and the City's Thirteenth Addendum to the 8th Declaration (Ex. MET-SAT-060), both March 9, 2021, following GA-34 (March 2, 2021)
What remained in force
The requirement that all commercial entities in Bexar County providing goods or services directly to the public 'must continue to post and implement a health and safety policy' (NW-20 sec. II; NW-21 sec. V); face coverings and health screening at controlled entrances of all Bexar County buildings (NW-20 sec. V; NW-21 sec. II) and in City facilities (fourteenth addendum); long-term-care and dialysis staff-movement and visitation clauses; eviction-procedure compliance with the Supreme Court of Texas and CDC orders; the City's Eighth Declaration (extended indefinitely June 11, 2020) and the County's local disaster declaration continued by NW-20 and NW-21 until 14 days after the statewide emergency ends; the Local Health Authority's school directives (February 2, 2021 recommendations; August 10, 2021 mandatory masking and quarantine); the VIA face-covering requirement under the CDC conveyance order; from August 4, 2021 the suspension of in-person jury service and the courthouse face-covering order. The stay-home orders ended May 19, 2020 (NW-07 expiry; NW-08 and the Seventh Declaration adopted GA-23).
The State and the local orders
The State's orders framed what the local orders could do. GA-18 (Apr. 27, 2020) opened Reopened Services statewide; NW-07 required businesses other than Essential and Reopened Services 'as defined by executive order GA-18' to close. From NW-08 (May 19, 2020) every County order recites that 'consistent with Executive Order GA-23 [later GA-26] issued by Governor Greg Abbott, no civil or criminal penalty will be imposed on individuals for failure to wear a face covering'; the June 17, 2020 NW-10 device placed the mask duty on businesses through a mandatory Health and Safety Policy enforceable by a $1,000 fine on the business. GA-28 (June 26, 2020) and its July 2 proclamation authorized the local outdoor-gathering caps of 100 and then 10 imposed by NW-11, NW-12 and NW-13; GA-29 (July 2, 2020) supplied the statewide mask mandate that NW-13 through NW-19 incorporated 'in accordance with executive order GA-29'; GA-32 (Oct. 7, 2020) supplied the bar opt-in exercised in NW-16 and the high-hospitalization 50 percent limit applied in NW-19. GA-34 (Mar. 2, 2021, effective Mar. 10) ended the statewide mask mandate and occupancy limits and barred local penalties for failure to wear a face covering; NW-20 and the thirteenth addendum followed it on Mar. 9-10, 2021. GA-36 (May 18, 2021) prohibited local governmental entities from requiring masks. GA-38 (July 29, 2021) provided that no governmental entity, including a county, city, school district and public health authority, may require any person to wear a face covering, suspended Tex. Gov't Code 418.1015(b) and 418.108, Health & Safety Code ch. 81 subch. E and chs. 121, 122 and 341, and Local Gov't Code ch. 54 to that extent, and imposed a fine of up to $1,000 for a conflicting local limitation (quoted in Exs. 070 and 074). GA-39 (Aug. 25, 2021) barred governmental vaccination mandates. Litigation: City of San Antonio and Bexar County v. Abbott, No. 2021-CI-16133 (45th Dist. Ct., Arteaga, J.): petition and TRO Aug. 10, 2021 (Ex. 065); TRO stayed by the Supreme Court of Texas Aug. 15, 2021, In re Abbott, No. 21-0687 (Ex. 069), except as to the temporary-injunction hearing; temporary injunction Aug. 16, 2021 after evidence from Dr. Woo, City Manager Walsh and County Manager Smith; injunction superseded automatically by the State's appeal (Tex. R. App. P. 29.1(b)); Fourth Court of Appeals order reinstating the injunction under Rule 29.3 Aug. 19, 2021, No. 04-21-00342-CV (Ex. 070); that order stayed by the Supreme Court Aug. 26, 2021, In re Abbott, No. 21-0720 (Ex. 071) ('The status quo, for many months, has been gubernatorial oversight of such decisions at both the state and local levels'); Fourth Court opinion affirming the injunction Nov. 10, 2021, 648 S.W.3d 498 (Ex. 074); petition for review filed Jan. 25, 2022, granted Jan. 27, 2023, argued Feb. 22, 2023; Supreme Court opinion June 30, 2023, No. 21-1079 (Ex. 075), vacating the judgment and dissolving the injunction under Abbott v. Harris County, No. 22-0124 (Ex. 076), which held the Disaster Act authorized GA-38; the Court stated that 'none of the injunctions issued by the lower courts has been enforceable during the pendency of this appeal.' Mandate Aug. 11, 2023; the 21-0720 stay lifted Sept. 15, 2023. Senate Bill 29 (Act of May 28, 2023, 88th Leg.) codified the prohibition at Tex. Health & Safety Code 81B.002 and GA-38 expired in June 2023. Consequence for Q3 2021: the Aug. 10, 2021 Health Directive, NW-21 and the fourteenth addendum were issued instruments of local authorities in force by their terms; they were protected by injunction Aug. 16-19 through Aug. 26, 2021 and thereafter GA-38 was enforceable against them; the Local Health Authority replaced the directive with an advisory on Oct. 1, 2021 (Ex. 073). The Bexar County courts' orders (jury suspension, courthouse masks, eviction procedures) rested on the Supreme Court of Texas's emergency orders and were not affected by GA-38.
