The record in brief

ScopeCounty and municipal instruments of the Orlando metropolitan area: Orange County (Mayor Jerry L. Demings as Director of Emergency Management), Osceola County (Board of County Commissioners and its Executive Policy Group), Seminole County (Chairman and Chief Administrator of Emergency Management), the City of Orlando (Mayor Buddy Dyer), the Ninth Judicial Circuit (Orange and Osceola Counties), Seminole County Public Schools and Orange County Public Schools, and the Central Florida Regional Transportation Authority (LYNX). Orange County acted before the State did and kept its own layer of orders in force for fourteen months. Mayor Jerry L. Demings declared a State of Local Emergency by Emergency Executive Order 2020-01 on March 13, 2020 (Ex. MET-ORL-001) and renewed it every seven days under Fla. Stat. 252.38(3)(a)5 without interruption from March 20, 2020 (EEO 2020-02) through at least May 7, 2021 (EEO 2021-20), a chain evidenced here by EEO 2020-02, 2020-07, 2020-40, 2020-54 and 2021-20 (Exs. MET-ORL-002, -051, -052, -053, -054). On March 20, 2020 EEO 2020-03 imposed a countywide curfew from 11:00 p.m. to 5:00 a.m., enforceable by arrest (Ex. MET-ORL-003); the curfew ran until 5:01 a.m. on May 11, 2020 (EEO 2020-14, Ex. MET-ORL-007). On March 24, 2020 EEO 2020-04 ordered every individual not to leave his or her residence except for enumerated activities, ordered all non-essential retail and commercial businesses temporarily closed (naming theme parks, water parks, museums, arcades, theaters, concert halls, bowling alleys, country clubs and social clubs), limited child care to stable groups of ten, and fixed a penalty of $500 or sixty days in jail; it took effect at 11:00 p.m. on March 26, 2020, two days before the Governor's EO 20-91 was signed and eight days before EO 20-91 took effect (Ex. MET-ORL-004). EEO 2020-05 of March 26, 2020 added a minimum-basic-operations allowance for closed businesses and confirmed that travel outside Orange County was a permitted purpose (Ex. MET-ORL-005). EEO 2020-16 (May 18, 2020) capped in-store retail, restaurant indoor seating and museums at fifty percent of capacity and kept bar counters closed (Ex. MET-ORL-012). The face-covering mandate followed on June 18, 2020 (EEO 2020-23, effective June 20) and was restated on June 24, 2020 (EEO 2020-25): every person working, living, visiting or doing business in Orange County, incorporated and unincorporated, must wear a face covering in any place open to the public, indoors or outdoors, for the duration of the local emergency (Exs. MET-ORL-008, -009). After the Governor's EO 20-244 (Sept. 25, 2020) suspended fines against individuals, Orange County moved enforcement onto businesses: EEO 2020-51 (Dec. 4, 2020, effective Dec. 6) required six-foot distancing, employee face coverings, customer face coverings, floor marking, partitions and signage in every business with on-site operations, enforceable by immediate citation ($500) and special-magistrate fines of $1,000 per day, $5,000 per day for repeat violations and $15,000 for irreparable violations (Ex. MET-ORL-010). EEO 2021-18 (Apr. 28, 2021) reduced distancing to three feet but kept the indoor face-covering mandate and the employer duty to enforce it (Ex. MET-ORL-011). The Governor's EO 21-102 (May 3, 2021) suspended those local mandates and ch. 2021-8 (SB 2006) invalidated them on July 1, 2021; the county's emergency declaration nonetheless continued (EEO 2021-20, May 7, 2021), and on July 28, 2021, with a fourteen-day positivity rate above fifteen percent and a record 1,371 cases in one day, the Mayor declared a new State of Local Emergency (EEO 2021-24, Ex. MET-ORL-013) that was renewed weekly through October 20, 2021 (EEO 2021-25 to 2021-36).

Osceola County's Executive Policy Group imposed a curfew from 11:00 p.m. on March 20, 2020 (Ex. MET-ORL-015), a shelter-in-place and business-closure order on March 25, 2020 (Emergency Order No. 2, effective 11:00 p.m. March 26, Ex. MET-ORL-016), restated it on March 27, 2020 (Emergency Order No. 3, Ex. MET-ORL-017), and on April 10, 2020 became one of the first jurisdictions in Florida to require face coverings in every public place (Emergency Order No. 4, with a $500 penalty, Ex. MET-ORL-018), replaced on April 13, 2020 by Emergency Order No. 5, which kept the mandate 'until further notice' (Ex. MET-ORL-019). The curfew was repealed effective May 4, 2020 (Ex. MET-ORL-020). On July 20, 2020 the Board of County Commissioners adopted Emergency Ordinance 2020-60, effective July 24, 2020, making the face-covering requirement a noncriminal infraction enforceable by the Sheriff, the Kissimmee and St. Cloud police and county code enforcement (Ex. MET-ORL-021). Seminole County's Chairman declared a Local State of Emergency on March 2, 2020 (EO 2020-001) and the county extended it every seven days through at least April 27, 2021 (EO 2021-019, Ex. MET-ORL-033; EO 2020-013, -048, Exs. MET-ORL-028, -050); it tolled all zoning, permit and code-enforcement deadlines from March 18, 2020 (EO 2020-004); it ordered COVID-positive persons to remain home under penalty of a $500 fine (EO 2020-009, Apr. 3, 2020, Ex. MET-ORL-027); it required social distancing and facial coverings from June 29, 2020 (EO 2020-030) and, after EO 20-244, suspended only the individual penalties while ordering that the mask and quarantine orders 'remain in place' (EO 2020-046, Sept. 28, 2020, Ex. MET-ORL-032); and its Building Division replaced in-person final inspections with contractor affidavits from March 24, 2020 (Ex. MET-ORL-036). The City of Orlando prohibited on-premises alcohol sales citywide on March 17, 2020 (Ex. MET-ORL-037), and Orange County's orders applied of their own force inside the city.

The Ninth Judicial Circuit closed its courthouses to the public and suspended jury trials from March 2020 (AO 2020-06 and amendments; AOSC20-13, -15, -23), moved briefly to limited in-person contact in June 2020, returned to Phase 1 (court facilities 'effectively closed to the public') on June 29, 2020 (AO 2020-06-05, Ex. MET-ORL-041), limited access again from January 11, 2021 with no jury trials until February 15, 2021 (AO 2020-06-06, Ex. MET-ORL-042), resumed Phase 2 with masks required at all times and six-foot distancing on February 15, 2021 (AO 2020-06-07, Ex. MET-ORL-043), relaxed masks and distancing on June 17, 2021 while keeping remote proceedings and barring symptomatic persons (AO 2020-06-09, Ex. MET-ORL-044), reinstated the mask requirement in every court facility in August 2021 (AO 2020-06-12, in force through September 30, 2021 and until 12:01 a.m. on November 1, 2021, when AO 2020-06-14 discontinued it, Ex. MET-ORL-045). Face coverings were therefore required by a governmental authority in the Orange and Osceola County courthouses on every day of the third quarter of 2021 except the six weeks between June 17 and the August reinstatement.

The quarter-by-quarter picture: 2020 Q2 opened under the Orange and Osceola stay-at-home and closure orders, curfews in both counties, the Seminole quarantine and tolling orders and the Ninth Circuit's closure, then moved (May 4 and May 18, 2020) to capacity caps of 25 and 50 percent with mandatory face masks for employees and patrons within six feet; 2020 Q3 opened under the Orange County face-covering mandate (June 20), the Osceola face-covering order and ordinance (Apr. 13 and July 24), the Seminole mask order (June 29) and the Ninth Circuit's return to Phase 1 (June 29), with State capacity caps to September 25, 2020; 2020 Q4 and 2021 Q1 ran under the local mask mandates without individual fines but with business-directed enforcement (EEO 2020-51), the courts' January 2021 closure and the weekly emergency renewals in all three counties; 2021 Q2 opened with every local mandate in force and closed with the mandates suspended (May 3) and void (July 1) but the emergencies and the court rules continuing; 2021 Q3 carried the Orange County Delta emergency from July 28, the courts' mask reinstatement, the school districts' masking rules and the federal transit and health care layer.

What remained in force

The county emergency declarations and their weekly renewals (Orange County EEO 2021-20, May 7, 2021, and the new declaration EEO 2021-24 of July 28, 2021 with renewals to Oct. 20, 2021; Seminole County's weekly renewals through at least Apr. 27, 2021); the Ninth Judicial Circuit's administrative orders on courthouse access, remote proceedings, exclusion of symptomatic persons and (from August 2021) face masks in all court facilities; the federal CDC conveyance order and TSA directives on LYNX, SunRail and Orlando International Airport; the OSHA COVID-19 Healthcare ETS (June 21, 2021).

The State and the local orders

Florida preempted its counties in three steps. (1) EO 20-91 (Apr. 1, 2020, effective Apr. 3) superseded conflicting local orders; the Orange and Osceola stay-at-home orders (Exs. MET-ORL-004, -005, -016, -017) had been in force since 11:00 p.m. on March 26, 2020 and the State order adopted the same essential-services structure; Orange County kept its curfew to May 11, 2020 (Ex. MET-ORL-007) and Osceola to May 4, 2020 (Ex. MET-ORL-020). (2) EO 20-244 (Sept. 25, 2020) suspended the collection of fines and penalties against individuals for COVID-19 orders and barred local governments from closing businesses or reducing restaurant capacity below fifty percent without findings; Orange County responded with EEO 2020-51 (Dec. 4, 2020), enforcing its mask and distancing standards against businesses through code enforcement (Ex. MET-ORL-010), and Seminole County responded with EO 2020-046 (Sept. 28, 2020), suspending individual penalties while ordering that the mask and quarantine orders remain in place (Ex. MET-ORL-032). (3) EO 21-102 (May 3, 2021) suspended all remaining local COVID-19 orders and mandates, and ch. 2021-8 (SB 2006), signed the same day and effective July 1, 2021, provides that a local emergency order 'must be narrowly tailored to serve a compelling public health or safety purpose' (Fla. Stat. 252.38(4)(b)), 'automatically expires 7 days after issuance but may be extended... in 7-day increments for a total duration of not more than 42 days' (252.38(4)(c)), and may be invalidated by the Governor 'at any time' if it 'unnecessarily restricts individual rights or liberties' (252.38(4)(d)); 381.00316 bars vaccination-documentation requirements. No local mask, distancing or capacity mandate on the public was in force in the Orlando metro after May 3, 2021; the county emergency declarations, court administrative orders and school-board rules were not displaced and are the local Q3 2021 layer. Litigation: the Orange County face-covering order was challenged in the Ninth Judicial Circuit in 2020 and remained in force.
