The record in brief

ScopeCity of Cleveland (Mayor's Proclamations of Civil Emergency, City Council ordinances and resolutions, Cleveland Municipal Court General and Housing Divisions), Cuyahoga County (County Executive executive orders, County Council, Cuyahoga County Board of Health, Court of Common Pleas General Division), and the Greater Cleveland Regional Transit Authority, March 2020 through September 30, 2021. Statewide Ohio instruments are cited by name and date only.

The Cleveland metropolitan regime ran in three layers under the statewide Ohio Department of Health orders. (1) City of Cleveland. Mayor Frank G. Jackson proclaimed a State of Civil Emergency at 1:00 p.m. on March 11, 2020 (Proclamation No. 1, Ex. MET-CLE-001), creating a Civil Emergency Executive Policy Group with power to suspend or amend City rules; on March 13 the City suspended utility disconnections; on March 16 it closed City buildings to the public, moved to an essential workforce, opened City Hall only Tuesdays and Wednesdays 9 a.m. to 2 p.m., and cancelled all public meetings of boards and commissions (Ex. MET-CLE-002). Council adopted Resolution 346-2020 on March 23, 2020 directing the Housing Court to suspend evictions for at least sixty days (Ex. MET-CLE-059). The Proclamation was extended on March 31 (to April 30), June 24 (to July 31), and November 18, 2020 (Proclamation No. 10, to December 31, 2020) and was still in effect on March 1, 2021 when Council fixed its meeting dates for the duration of the emergency (Res. 135-2021). On July 3, 2020, with Cuyahoga County at Level 3 (Red) on the Ohio Public Health Advisory System, the Mayor amended the Proclamation to mandate masks for all individuals in public and in businesses, cap bars, restaurants and entertainment venues at 50 percent of capacity, order shutdown of any establishment after two capacity violations, enforce the ten-person gathering limit, and require sanitization after a positive employee or patron (Ex. MET-CLE-005). Council codified those rules on July 15, 2020 in Ordinance No. 556-2020, enacting Codified Ordinances Chapter 602 (facial coverings in every indoor non-residential location and outdoors where six feet cannot be kept; $25 civil penalty after warning), Section 437.30 (masks in vehicles for hire), Chapter 236 (Dine Safe Ohio implementation: seated service only, posted capacity from compliant floor plans, employee and patron masks; $1,000 first and $3,000 subsequent civil penalties; emergency nuisance abatement) and Chapter 238 (sanitization before reopening after a symptomatic positive employee; $1,000 per offense) (Ex. MET-CLE-058). Chapter 602 expires only with the Proclamation; Chapter 236 expired with the Dine Safe Ohio Order (rescinded June 2, 2021). On November 18, 2020 the Mayor's Proclamation No. 10 added a Stay At Home Advisory through December 31, 2020, issued jointly with the County and both boards of health (Ex. MET-CLE-007). (2) Cuyahoga County. County Executive Armond Budish declared a county State of Emergency by EO2020-0002 on March 11, 2020 (Ex. MET-CLE-045), implemented the State mass-gathering order countywide and extended it to athletic events of more than 100 participants by EO2020-0003 (March 16, 2020, Ex. MET-CLE-046), imposed travel disclosure and quarantine rules on County employees by EO2020-0004 (March 17, 2020, Ex. MET-CLE-047), closed all County buildings to the public from mid-March until the administrative headquarters reopened July 7, 2020, suspended tax foreclosures and Sheriff sales for sixty days from March 19, 2020 (Ex. MET-CLE-008), required face coverings in County buildings from May 14, 2020 (EO2020-0007, Ex. MET-CLE-049), and on December 31, 2020 issued EO2020-009 (screening and face coverings in County buildings, Ex. MET-CLE-051) and EO2020-010 (countywide order that residents comply with Social Distancing Requirements and avoid gatherings of more than ten outside a household, implementing the ODH May 29, 2020 order and the Board of Health's Stay-at-Home Health Advisory, Resolutions 2020-143 and 2020-156, Ex. MET-CLE-052). The County re-issued its building orders on April 8, 2021 (EO2021-0010, Ex. MET-CLE-056; nonessential County travel restricted, EO2021-0008, Ex. MET-CLE-054), June 16, 2021 (EO2021-0012, Ex. MET-CLE-057), June 28, 2021 (EO2021-0014, Ex. MET-CLE-061, in force July 1 to August 3, 2021, masks and temperature screening for all visitors, vaccinated employees exempt) and August 3, 2021 (EO2021-0016, Ex. MET-CLE-009: every visitor and employee screened for temperature and mask-wearing and denied entry if unmasked; rescinded only on March 2, 2022 by EO2022-0004, Ex. MET-CLE-062). The county State of Emergency (EO2020-0002) ended June 28, 2021 (EO2021-0013, Ex. MET-CLE-060). The Board of Health issued a Stay-at-Home Health Advisory in November 2020 (Res. 2020-143, extended to January 15, 2021 by Res. 2020-156), and in Q3 2021 issued masking recommendations (August 4, 2021, Ex. MET-CLE-010), 2021-22 school guidance (August 3, 2021, Ex. MET-CLE-011), required masks at its own locations, and with the County Executive issued a countywide Mask Advisory on September 15, 2021 (Ex. MET-CLE-012). (3) Courts and transit. The Court of Common Pleas, General Division, declared a judicial emergency on March 16, 2020 (jury trials suspended, all in-person civil proceedings except emergencies suspended, foreclosures stayed sixty days, health screening at the Justice Center, Ex. MET-CLE-014), ran reduced dockets from March 20 (Ex. MET-CLE-015, -016), extended the emergency April 28 and May 26, 2020 (Ex. MET-CLE-017, -018; face coverings required in the Justice Center), stayed foreclosure execution and Sheriff's deeds to July 31, 2020 (Ex. MET-CLE-019), kept jury trials suspended until September 21, 2020 (Ex. MET-CLE-020, -021), suspended them again from November 18, 2020 until April 26, 2021 (Ex. MET-CLE-022, -023, -024), re-imposed masks and temperature screening for every visitor and employee on August 5, 2021 (Ex. MET-CLE-025), and ordered vaccination of all staff by October 15, 2021 (August 31, 2021, Ex. MET-CLE-026) and of all appointed counsel, mediators, arbitrators and guardians (September 10, 2021, Ex. MET-CLE-027). The Cleveland Municipal Court issued a parallel series from March 13, 2020 through its September 17, 2021 staff vaccination order (Ex. MET-CLE-028 to -036), and its Housing Division cancelled non-eviction civil hearings from March 16, 2020 and administered the CDC eviction stays through August 27, 2021 (Ex. MET-CLE-035). GCRTA suspended Park-N-Ride and trolley service by March 26, 2020, converted paratransit to curb-to-curb, cut service systemwide from April 12, 2020, told riders to ride only for essential trips (April 15, 2020), required masks from at least July 21, 2020, and enforced the federal transit mask mandate through and beyond September 30, 2021 (Ex. MET-CLE-038 to -042). Ohio did not preempt municipal mask ordinances; Senate Bill 22 (effective June 23, 2021) stripped local boards of health of power to issue general orders, which is why the Board of Health's Q3 2021 instruments are advisories while the County Executive and the courts continued to issue binding orders for their buildings and staff.

The State and the local orders

Ohio did not bar municipal COVID ordinances during the period; Cleveland's Ordinance No. 556-2020 (July 15, 2020) operated alongside the ODH statewide mask order and imposed stricter enforcement (civil penalties, nuisance abatement). The General Assembly's Senate Bill 22 (134th G.A.), vetoed March 23-24, 2021 and enacted over the veto on March 24, 2021 (Senate 23-10, House 62-35), took effect June 23, 2021: it limits a local board of health to quarantine and isolation orders directed at persons medically diagnosed or in direct contact with a diagnosed person (R.C. 3707.11), eliminates local boards' authority to close schools generally or prohibit public gatherings, and provides that any local board order applying to a class of persons rather than specific diagnosed, exposed or documented-incident individuals and businesses is invalid (R.C. 3709.212). It also made ODH orders subject to rescission by concurrent resolution and terminated states of emergency by operation of law on July 23, 2021 unless extended. SB 22 did not address home-rule municipal ordinances or the county executive's authority over county property, which is why in Q3 2021 the Cuyahoga County Board of Health issued recommendations and advisories (Ex. MET-CLE-010, -011, -012) while the County Executive (EO2021-0016) and the courts issued binding orders.
