The record in brief

ScopeDallas-Fort Worth metropolitan area: Dallas County, Tarrant County, Collin County, Denton County; City of Dallas; City of Fort Worth; the Dallas County and Tarrant County Local Health Authorities; the Dallas County, Collin County and Denton County courts; DART, Trinity Metro, the Trinity Railway Express and DCTA; the Abbott v. Jenkins litigation (116th District Court, Fifth Court of Appeals, Supreme Court of Texas). Statewide instruments are cited by name and date only and live in States/TX.

The DFW local layer began on March 12-13, 2020, when the Dallas County Judge (MET-DFW-001), the Tarrant County Judge, the Denton County Judge (MET-DFW-073) and the Mayors of Dallas and Fort Worth declared local disasters under Tex. Gov't Code section 418.108, and Collin County followed on March 15 (MET-DFW-066). Within a week every jurisdiction had ordered gatherings capped (500, then 50, then 10), restaurants confined to take-out and delivery, and bars, gyms, theaters and private clubs closed (MET-DFW-002, MET-DFW-003, MET-DFW-004; Tarrant's First and Second Amended Declarations, MET-DFW-039, MET-DFW-040, which also capped event centers, hotel ballrooms, retail stores, plazas, places of worship and malls at 50 percent of certificate occupancy or 125 persons; Fort Worth's Second and Third Amended Declarations, MET-DFW-057, MET-DFW-058). Between March 22 and March 25, 2020 Dallas County (Stay Home Stay Safe, MET-DFW-005), Tarrant County (MET-DFW-042, MET-DFW-043), Fort Worth (Fifth Amended Declaration, MET-DFW-060), Denton County (Executive Order AE-20-03-24, MET-DFW-077) and Collin County (Second Executive Order, MET-DFW-068) ordered every resident to stay at home, every non-essential business to cease activity at its facilities or close to the public, every gathering outside a household prohibited, worship confined to video and teleconference, and every elective medical, surgical and dental procedure prohibited, on pain of a fine up to $1,000 and confinement up to 180 days. Those orders were extended by county judges, commissioners courts and city councils through April 30, 2020 (Dallas County to May 15) and were supplemented by binding sector rules: construction-site rules (MET-DFW-008), manufacturer and distributor rules (MET-DFW-011), long-term-care control orders (MET-DFW-009, MET-DFW-020, MET-DFW-025), food-processing-plant rules (MET-DFW-018) and Retail-to-Go rules (MET-DFW-016). Dallas County's Supplemental Order of May 4, 2020 (MET-DFW-017) confined reopened retail, dine-in restaurants, theaters, malls, museums and libraries to 25 percent of listed occupancy and converted the Governor's 'recommended' Minimum Standard Health Protocols into mandatory county rules. The second phase ran from June 19, 2020 (Dallas County, MET-DFW-021, re-issued August 4, MET-DFW-023) and June 26, 2020 (Tarrant County, MET-DFW-048, extended July 31, August 25 and November 24, 2020 and February 23, 2021, MET-DFW-050, MET-DFW-052) to March 10, 2021: every commercial entity providing goods or services to the public had to adopt, post and enforce a Health and Safety Policy requiring face coverings, on pain of a fine per violation, alongside the statewide GA-28/GA-29/GA-32 regime; the Local Health Authorities closed sexually oriented clubs and cigar bars (Dallas, MET-DFW-022) and kept schools closed to on-campus instruction (Dallas, July 16 to August 10, 2020, MET-DFW-026; Tarrant, Arlington and Burleson, July 21 to September 27, 2020, MET-DFW-049); and the region's GA-32 high-hospitalization status from December 3, 2020 cut occupancy to 50 percent and closed bars across TSA E (MET-DFW-027, MET-DFW-051). What stayed in force after GA-34 (March 10, 2021): the Dallas County long-term-care order (MET-DFW-025, to March 8, 2022, MET-DFW-033), the Dallas County continuing-requirements order (MET-DFW-024, concurrent with the Governor's proclamation), the Local Health Authority closure order (MET-DFW-022, 'until rescinded'), the Dallas eviction-notice ordinance (MET-DFW-034), the City of Dallas Emergency Regulations (Twelfth Amended, Ordinance 31865, May 19, 2021, MET-DFW-037, in force through 2021 Q3 with a $50-$1,000 penalty), the City's face-covering regulation for city buildings until May 21, 2021 (MET-DFW-036), the county disaster declarations (Dallas, Tarrant renewed September 29, 2021, MET-DFW-055; Denton 'until cancelled', MET-DFW-074), the courts' emergency orders (Collin to May 27, 2021, MET-DFW-072) and the CDC transit mask order on every DART, Trinity Metro, TRE and DCTA vehicle (MET-DFW-094). In the third quarter of 2021 Dallas County answered GA-38 with the Order on Required Use of a Face Mask in Certain Public Space (August 11, 12 and 16, 2021, MET-DFW-028, MET-DFW-029, MET-DFW-030, MET-DFW-031): every commercial entity, child-care center, Pre-K-12 public school and public college in the county had to adopt and post a Health and Safety Policy mandating universal indoor masking, with a fine up to $1,000 per violation, and masks were required in every county building; the order was litigated to a temporary injunction on August 25, 2021, affirmed by the Fifth Court of Appeals on November 22, 2021 (MET-DFW-096), and remained on the county's books until modified on February 25, 2022 (MET-DFW-032) and beyond (MET-DFW-033). The Dallas and Richardson Independent School Districts' face-covering rules were in force through the quarter (MET-DFW-095). Transit agencies cut service from March 23 and April 6, 2020 (MET-DFW-088, MET-DFW-087, MET-DFW-091) and required masks from June 26, 2020 (MET-DFW-092) and, under the CDC order, from February 1, 2021 (MET-DFW-094).

End of general restrictions

Instrument Local stay-home and closure orders expired at 11:59 p.m. on April 30, 2020 (Dallas County to May 15, 2020 for Reopened Services, MET-DFW-015, MET-DFW-017; Tarrant MET-DFW-046, MET-DFW-047; Fort Worth MET-DFW-061, MET-DFW-063; Collin MET-DFW-070; Denton MET-DFW-080, MET-DFW-081). The general business regime that followed was the State's (GA-18 to GA-32) and ended with Executive Order GA-34 (March 2, 2021; effective March 10, 2021), which also superseded the Dallas County and Tarrant County business face-covering mandates (MET-DFW-023, MET-DFW-048, MET-DFW-052).

The State and the local orders

GA-14 (Mar. 31, 2020) superseded local orders only to the extent they restricted essential services or allowed gatherings the order prohibited; the Dallas County orders from Apr. 2 (MET-DFW-010) and the Tarrant and Fort Worth orders from Apr. 3 and Apr. 7 (MET-DFW-046, MET-DFW-061) recite GA-14 and were drafted to harmonize with it; Denton County's May 12 and June 2, 2020 orders recite that GA-14 'superseded any local Disaster Declaration' (MET-DFW-083, MET-DFW-084). GA-18 (Apr. 27, 2020) barred local penalties for not wearing a face covering; the counties responded on June 19 and June 25, 2020 by placing the mandate on businesses (MET-DFW-021, MET-DFW-048), a device the Governor's June 23, 2020 amendment allowed (recited in MET-DFW-048) and GA-29 (July 2, 2020) ratified. GA-34 (effective Mar. 10, 2021) barred any jurisdiction from requiring face coverings and lifted capacity limits; Tarrant County's Feb. 23, 2021 extension to May 25, 2021 (MET-DFW-052) and Dallas County's Aug. 4, 2020 business order (MET-DFW-023) were superseded that day. GA-36 (May 18, 2021) extended the bar to every governmental entity and official with a fine up to $1,000; the City of Dallas rescinded Ordinance 31792 in obedience to it (MET-DFW-036). GA-38 (July 29, 2021) consolidated the prohibitions; Dallas County's Aug. 11, 2021 order (MET-DFW-028) was met by a TRO (Aug. 10) stayed by the Supreme Court of Texas (Aug. 15, Ex. TX-044), a temporary injunction (Aug. 25) that the State's appeal superseded under Tex. R. App. P. 29.1(b) (MET-DFW-097 at 2), an affirmance by the Fifth Court of Appeals (Nov. 22, 2021, MET-DFW-096) and a vacatur by the Supreme Court of Texas (June 30, 2023, MET-DFW-097). The county's order remained issued, posted and applied as county policy throughout and was modified rather than withdrawn on Feb. 25, 2022 (MET-DFW-032, MET-DFW-033). School-district mandates in the metro operated in fact for the rest of 2021 Q3 (MET-DFW-095; TEA statement of Aug. 19, 2021, Ex. TX-053).
