The record in brief

ScopeAllegheny County, Pennsylvania (Allegheny County Health Department; County Executive), City of Pittsburgh (Mayor; City Council), the Fifth Judicial District of Pennsylvania (Court of Common Pleas of Allegheny County, Magisterial District Courts, Pittsburgh Municipal Court), and the Port Authority of Allegheny County. Statewide Pennsylvania instruments are cited by name and date only.

Allegheny County and Pittsburgh operated under three overlapping local layers between March 12, 2020 and September 30, 2021, each with force of law and each independent of the Governor's disaster proclamation: (1) the Allegheny County Health Department (ACHD), a county department of health under the Local Health Administration Law, 16 P.S. 12001-12028, and the Disease Prevention and Control Law of 1955, 35 P.S. 521.1 et seq., whose Director issued five Control Measure Orders between June 28 and August 28, 2020 that closed or restricted bars, restaurants, nightclubs, taverns and the casino, capped gatherings and events, imposed an 11:00 PM closing hour on all dine-in seating and banned indoor dining countywide for a week, on top of the Commonwealth's orders; (2) the City of Pittsburgh, whose Mayor declared a disaster emergency on March 13, 2020 (ratified by Council March 17, 2020 and renewed by resolution about every one to five weeks through August 3, 2021), issued Executive Orders 2020-001 and 2020-002 prohibiting community gatherings above 250 and then 50 persons from March 16, 2020, and whose Council enacted Chapter 626A (Ordinance 41 of 2020, December 8, 2020) and Chapter 626B (Ordinance 23 of 2021, July 27, 2021) requiring employers with 50 or more employees to provide 80 hours of COVID-19 sick time, and Chapter 782 (Ordinances 6 and 12 of 2021) regulating residential evictions; and (3) the Fifth Judicial District, which declared a judicial emergency on March 16, 2020 and kept it in force, by declarations and Supreme Court authorizations under Pa.R.J.A. No. 1952(B)(2), through October 1, 2021, closing court facilities to the public (March 26, 2020), suspending jury trials (to October 19, 2020 and again in winter 2020-21), staying writs of possession and sheriff sales, prohibiting new residential landlord-tenant filings (August 7-31, 2020), requiring masks in every court facility (June 11, 2020 to July 1, 2021 and again from August 10, 2021), ordering remote-only operations for defined windows (November 24-December 4, 2020; December 7, 2020-January 8, 2021; April 5-30, 2021; May 3-28, 2021), continuing residential sheriff sales to September 7, 2021, and imposing landlord-tenant procedures through October 31, 2021. The Port Authority of Allegheny County cut service to reduced schedules from March 25, 2020, capped riders at 10, 15 and 25 per vehicle, required face coverings of every rider and employee, and kept those limits in force into 2021. By quarter: 2020 Q2 opened under the county and city emergency declarations, the city gathering bans, the judicial emergency with courthouses closed to the public and trials suspended, county offices closed to the public, and the Port Authority's reduced service and rider caps, all beneath the Commonwealth's business-closure and stay-at-home orders (March 19 and 23, 2020) that named Allegheny County; it closed with the county in the Green Phase (June 5, 2020) but with masks required in court facilities, jury trials still suspended, and the ACHD's June 28, 2020 order in force (no on-site alcohol consumption in any bar, restaurant or business, enforced from 5:00 PM June 30). 2020 Q3 is the county's most intense local period: the July 2 order closed bars, restaurants, nightclubs, casinos and taverns to in-person operation July 3-10 and capped gatherings at 25; the July 8 order (effective July 10) prohibited indoor dining and alcohol consumption countywide, allowed only seated outdoor service with a three-drink maximum and an 11:00 PM cutoff, reopened the casino without food, beverage or smoking, and prohibited events above 25 indoors and 50 outdoors; the July 17 order (effective 5:00 PM) closed all dine-in seating at 11:00 PM nightly and kept the 25/50 gathering caps alongside the Secretary of Health's July 15, 2020 order (25 percent indoor dining, alcohol only with meals); the August 28 order raised the outdoor cap to 100; the Director lifted the county orders September 24, 2020, leaving the Commonwealth's masking, telework, worker-safety, building-safety and occupancy orders in force countywide. The courts extended the judicial emergency to December 31, 2020 and re-plan operations August 31, 2020 with masks, occupancy limits and landlord-tenant procedures. 2020 Q4 saw the ACHD's November 18 stay-at-home advisory, the court's remote-only orders of November 20 and December 3 (extending the emergency to March 31, 2021), and Pittsburgh's Chapter 626A, beneath the Commonwealth's November 17 and 23 and December 10, 2020 orders. 2021 Q1 and Q2 carried the judicial emergency (extended to August 31, 2021), remote-only and remote-first court windows, the March 26 remote-public-access order, criminal jury trials resuming April 27, 2021, the June 2 sheriff-sale continuances, Chapter 782 (March 3, 2021) and the city declaration's renewals to August 3, 2021; the Commonwealth's mitigation orders ended May 31, 2021 and its mask order June 28, 2021. 2021 Q3 was not a quarter without orders in Allegheny County: the Fifth Judicial District's judicial emergency, remote-technology authorization and Rule 600 suspension ran through October 1, 2021 (AD-21-128, August 31, 2021); masks were again required in every court facility from August 10, 2021 (AD-21-118); landlord-tenant procedures ran through October 31, 2021 (AD-21-110, August 6, 2021); residential sheriff sales were postponed to September 7, 2021; Pittsburgh's Chapter 626B took effect July 27, 2021 (80 hours of COVID-19 sick time, employers of 50 or more, 365 days); the County Executive required unvaccinated county employees and visitors to county buildings to mask and be tested from August 2021, made vaccination a condition of new county employment from August 9, 2021 and announced a December 1, 2021 vaccination requirement for county employees on September 29, 2021; the City imposed the same vaccinate-or-mask-and-test rule on its workforce in August 2021 (Executive Order No. 7 of November 1, 2021 recites the August 9, 2021 new-hire vaccination condition); the ACHD's isolation and quarantine directions (updated July 26 and August 24, 2021) governed every exposed worker; and the Port Authority's face-covering rule continued under the CDC conveyance order. The Commonwealth's school masking order (August 31, 2021, effective September 7, 2021) reached every Allegheny County school; the ACHD Director endorsed it September 3, 2021.

What remained in force

The State and the local orders

Pennsylvania did not preempt or bar local COVID-19 orders. The ACHD's Control Measure Orders rested on the Local Health Administration Law (16 P.S. 12012(d)) and the Disease Prevention and Control Law (35 P.S. 521.5; 28 Pa. Code 27.60), authority that does not depend on the Governor's disaster proclamation; each ACHD order recites that it supplements, and does not replace, the Commonwealth's orders. The General Assembly's termination of the Governor's disaster emergency (H.R. 106, June 10, 2021) and the constitutional amendments approved May 18, 2021 (Pa. Const. art. III, sec. 9; art. IV, sec. 20) reached the Governor's proclamation, not county health departments, municipal emergency declarations under 35 Pa.C.S. 7501, or the judiciary's emergency powers under Pa.R.J.A. No. 1952. No injunction against any Allegheny County or Pittsburgh instrument was located. The ACHD orders were withdrawn by the Director on September 24, 2020, not by any court or by state preemption. The Commonwealth's school masking order of August 31, 2021 was later declared void in Corman v. Acting Secretary of Health (Pa. Cmwlth. Nov. 10, 2021; Pa. Dec. 10, 2021), after the period.
