The record in brief

ScopeSan Diego County (Public Health Officer orders, emergency regulations, local emergency, isolation and quarantine orders) and the City of San Diego (mayoral proclamation and executive orders, Council emergency resolutions and ordinances), with the Court of Appeal decision on the December 2020 restaurant injunction and the Judicial Council listing of the San Diego Superior Court's fifteen 2020 emergency orders. Statewide instruments are cited by name and date only.

San Diego County ran one of the earliest and most continuously amended local regimes in the country. The County proclaimed a local emergency and the Public Health Officer declared a local health emergency on February 14, 2020 (ratified by the Board of Supervisors February 19, 2020) because of the federal quarantine of Wuhan evacuees at MCAS Miramar (Ex. MET-SAN-001). The Health Officer's first Order of March 12, 2020 (effective March 13) prohibited gatherings of 250 or more and barred non-essential personnel from hospitals and long-term care facilities; the March 16 amendment (effective March 17) prohibited gatherings of 50 or more, closed bars and other alcohol-only establishments, prohibited all on-site dining, ordered every business to enact social distancing and make every effort to telecommute, closed all school, college and university campuses, ordered hospitals to delay elective procedures, and imposed a 14-day home quarantine on arrivals from CDC Level 3 countries; Addendum 2 (effective March 18) closed gyms and fitness centers and Addendum 3 (effective March 24) ordered beaches and parks closed where distancing could not be enforced (Ex. MET-SAN-002). Second quarter of 2020: the Order effective March 29 implemented Executive Order N-33-20 locally, prohibited gatherings of 10 or more, kept bars, dine-in service and gyms closed, closed campuses, limited child care to stable groups of 10, and imposed quarantine on international arrivals; its addenda of April 2 and 3 required face coverings for public-facing employees from April 4, closed beach and park parking lots, and prohibited recreational boating and swimming (Ex. MET-SAN-003). The Order effective April 9 ordered all persons to remain in their homes except for essential business travel, closed every non-essential business, defined a prohibited gathering as more than one person outside a household, and required every essential business open to the public to post and implement a Social Distancing and Sanitation Protocol (Exs. MET-SAN-004, -025). Face coverings became mandatory for the public on May 1 and for all essential-business employees on May 8 (Ex. MET-SAN-006). Reopening ran by County order in lockstep with the State's Resilience Roadmap: curbside retail and reopened businesses under a mandatory Safe Reopening Plan from May 9 (Exs. MET-SAN-007, -026); dine-in restaurants and in-store retail under a COVID-19 Restaurant Operating Protocol from May 22 (Ex. MET-SAN-008); bars serving meals, gyms, worship and further sectors from June 19 with dance floors and live performances closed (Ex. MET-SAN-009). Third quarter of 2020: the Order effective July 1 re-closed bars, wineries, distilleries and breweries not serving meals and closed all food and alcohol establishments from 10:00 p.m. to 5:00 a.m. (Ex. MET-SAN-010); the Order effective July 7 closed indoor restaurant service and made the State's July 1 and July 13 closures operative in the county (Exs. MET-SAN-011, -012); the Order effective September 1 placed the county in the Blueprint for a Safer Economy's Red (Substantial) tier with the State's sector chart incorporated as County law (Ex. MET-SAN-013); the Order effective October 10 added sign-in requirements for indoor personal-care customers, the employer duty to report every employee case to the County, and the live-entertainment prohibition that produced the Midway Venture litigation (Ex. MET-SAN-014). Fourth quarter of 2020: the county fell to the Purple (Widespread) tier effective November 14 (Ex. MET-SAN-015); the Order effective November 21 incorporated the State's Limited Stay at Home Order and closed restaurants and bars from 10:00 p.m. to 5:00 a.m. (Ex. MET-SAN-016); the Order effective 11:59 p.m. December 6 made the State's Regional Stay at Home Order operative countywide, closing outdoor dining, personal care and playgrounds and limiting retail and lodging (Exs. MET-SAN-017, -018). In December 2020 the Superior Court preliminarily enjoined enforcement of the restaurant restrictions countywide; the Court of Appeal stayed the injunction on the State's emergency application and reversed it on January 22, 2021 (Ex. MET-SAN-027). First quarter of 2021: the Order of January 25 returned the county to Purple-tier rules with the 10:00 p.m. closure of restaurants and bars (Ex. MET-SAN-019); the Order of February 6 added the State's youth-sports guidance (Ex. MET-SAN-020) and remained the operative County order while the State moved the county through the Red and Orange tiers. Second quarter of 2021: the Order of May 6 was the last full order (Ex. MET-SAN-021); the Limited Order effective June 15, 2021 expired the general order and every other COVID-19 order except the Isolation Order dated December 24, 2020, the Quarantine Order dated April 5, 2021 and individual isolation and quarantine orders, and directed all governmental entities to continue enforcing State and local COVID-19 law (Ex. MET-SAN-022). Third quarter of 2021: the local emergency and local health emergency continued (the County ended them effective February 28, 2023); the Isolation Order of December 24, 2020 and the Quarantine Order as revised July 22, 2021 (10 to 14 days of quarantine for every unvaccinated close contact, with return-to-work rules for health-care and social-service staff) bound every resident and employer in the county (Exs. MET-SAN-023, -024); the City's local emergency was continued by Council resolution on August 13, 2021 and again by a resolution finally passed October 1, 2021, the latter reciting Mayor Gloria's August 13, 2021 extension of Executive Order 2021-1 capping third-party delivery fees (Exs. MET-SAN-041, -042); the City's temporary outdoor-operations code amendments for restaurants, retail, fitness, personal services and places of worship ran to July 13, 2022 (Exs. MET-SAN-039, -040). The County issued no local mask order in 2021; its August 25, 2021 indoor-mask statement was a recommendation, and the operative mask, school, health-care-worker and employer rules in the third quarter of 2021 were the State's (CDPH face-covering guidance of June 15, 2021; CDPH K-12 guidance of July 12, 2021; State Public Health Officer Orders of July 26, August 5 and August 11, 2021; The City of San Diego layer: Mayor Faulconer proclaimed a local emergency March 12, 2020 (ratified March 17, 2020 by R-312895); Executive Order 2020-1 (March 16) prohibited gatherings of 50 or more, closed bars, nightclubs and on-premises dining, closed all City buildings to the public, suspended parking enforcement and utility shutoffs; Executive Order 2020-2 (March 30) extended it to April 30, closed all City parks, beaches, trails, boardwalks and bays, and ordered landlords to comply with the March 25 eviction moratorium (O-21177); Executive Order 2020-3 (April 30) extended both to May 31, reopened parks and beaches for limited individual use, required every resident to carry and wear a face covering and kept the Convention Center as a shelter (Exs. MET-SAN-028 to -034). The Council's COVID-19 Worker Recall and Retention ordinance (O-21231, September 8, 2020) imposed recall and retention duties on hotel, event-center and commercial-property employers; the 2021 eviction ordinances (O-21293, O-21294) and the November 29, 2021 mandatory vaccination policy (O-21398) are recorded with their exact effective clauses (Exs. MET-SAN-036 to -038, -043). California did not preempt local orders; the Health Officer's orders were enforced by cease-and-desist letters and closure orders (more than 300 posted by the County in 2020-21) and were sustained on appeal in Midway Venture.

The State and the local orders

None. California never barred local COVID-19 orders; Executive Order N-33-20 and the State Public Health Officer's orders set a floor, and the County's orders recite that they operate 'in conformance with, and where not superseded by' the State orders while imposing additional local requirements (Ex. MET-SAN-003 sec. 1). The one injunction against the County regime, the Superior Court's December 2020 preliminary injunction in Midway Venture LLC v. County of San Diego (Super. Ct. No. 37-2020-00038194-CU-CR-CTL) barring enforcement of restaurant restrictions against every restaurant in the county, was stayed by the Court of Appeal on the State's emergency application and reversed with directions on January 22, 2021 (Ex. MET-SAN-027, 60 Cal.App.5th 58). The County's orders were therefore in force without interruption from March 13, 2020 to June 15, 2021, and the isolation and quarantine orders thereafter.
