Summary

Public utility commissions, legislatures and governors in at least twenty-eight States and the District of Columbia ordered electric, gas, water and sewer utilities to stop disconnecting customers for nonpayment in March 2020, and the orders stayed in force for months and, in several States, into the third quarter of 2021. Kentucky's Public Service Commission ordered on March 16, 2020 that 'utilities shall cease disconnections for non-payment' and 'shall waive all late payment charges' until otherwise ordered (Ex. 001), lifted the moratorium only on October 20, 2020, and then compelled every utility to offer default payment plans of six months to two years for arrearages accrued March 16 through October 1, 2020 and to forgo residential late fees through December 31, 2020 (Ex. 002). Arkansas's Commission ordered all jurisdictional electric, gas and water utilities to 'suspend disconnections... during the pendency of the Governor's emergency declaration' and suspended every tariff provision conditioning reconnection (Ex. 003). Texas's Commission on March 26, 2020 suspended the disconnection and late-fee rules for water, sewer and electric utilities, required every retail electric provider to offer deferred payment plans, and created the COVID-19 Electricity Relief Program under which retail electric providers 'must cease disconnections of eligible residential customers'; the disconnection exceptions ran to August 31, 2020 and the Program's disconnection exemption ended September 30, 2020 (Ex. 016-020). New York enacted the moratorium into the Public Service Law: no utility 'shall terminate or disconnect services to any residential customer for the non-payment of an overdue charge for the duration of the state disaster emergency' and, for COVID-affected customers, for 180 days after it (ch. 108, June 17, 2020, Ex. 006), extended on May 11, 2021 to the earlier of 180 days after the emergency or December 31, 2021 (ch. 106, Ex. 007), which kept the prohibition in force through the whole third quarter of 2021. Connecticut's PURA directed all regulated electric, gas and water companies to cease residential terminations on March 12-13, 2020, extended the moratorium to all non-residential customers through May 1, 2020, and ended the non-hardship residential moratorium September 30, 2020 while barring disconnection of any customer enrolled in the COVID-19 Payment Program (Ex. 008, 011, 012; CT-065). Illinois's Commerce Commission urged every public utility to cease disconnections and late fees until May 1, 2020 (Ex. 009), entered an emergency interim order on March 18, 2020 and a stipulated moratorium that expired June 26, 2020, and on September 4, 2020 asked the large utilities to extend the residential moratorium to March 31, 2021 (Ex. 010). Michigan's Governor ordered every public water supply to restore water service to occupied residences and to report to the State Emergency Operations Center (Ex. 013). Washington's Proclamation 20-23 series barred utility disconnections and late fees from March 18, 2020 to September 30, 2021 (WA-014); New Jersey's EO 190, 229 and 246 barred them to June 30, 2021 with a grace period to December 31, 2021 (NJ-059 to -061); North Carolina's EO 124 and 142 ran March 31 to July 29, 2020 (NC-006, NC-012); Indiana, Kansas, Colorado, Montana and Delaware acted by gubernatorial order in March 2020 (IN-004, KS-004, CO-008, MT-011, DE-009). Price-gouging law was activated in nearly every State by the emergency declaration itself and was made stricter by new instruments: Minnesota EO 20-10 (March 20, 2020) prohibited 'all persons' from selling 'any essential consumer goods or services for an amount that represents an unconscionably excessive price' (more than 20 percent above the pre-emergency price) for the duration of the peacetime emergency, to July 1, 2021 (Ex. 031); California EO N-44-20 capped increases on food, consumer goods and medical and emergency supplies at 10 percent over the February 4, 2020 price from April 4 to September 4, 2020 (Ex. 032); Michigan EO 2020-18 and 2020-53 imposed a 20 percent cap over March 9, 2020 prices and made willful violation a misdemeanor (Ex. 033, 034); New York's ch. 90 of 2020 extended General Business Law 396-r to 'all parties within the chain of distribution' of any goods or services vital to health, safety or welfare, with penalties of $25,000 or three times gross receipts (Ex. 035); Colorado enacted C.R.S. 6-1-730 (Ex. 036); Maryland's COVID-19 Public Health Emergency Protection Act authorized a 10 percent profit cap and forbade termination of quarantined employees (Ex. 037); Massachusetts's Attorney General amended 940 CMR 3.18 on March 20, 2020 to reach every business 'at any point in the chain of distribution or manufacture' (Ex. 038). Eviction moratoria and rental-assistance conditions are covered in the State files; this cluster adds Michigan EO 2020-19 (Ex. 051) and New York's Emergency Rental Assistance Program statute, under which eviction proceedings 'shall be stayed pending a determination of eligibility' (Ex. 052, in force through the third quarter of 2021). State tax agencies postponed April 15, 2020 filing and payment deadlines to July 15, 2020 (New York N-20-2, Ex. 081; New Jersey P.L.2020 c.19, Ex. 082; Alabama AL-068; West Virginia WV-011; Ohio OH-012). in 2020 Q3 the utility moratoria of Kentucky, Arkansas, Texas, New York, Connecticut, Pennsylvania, Illinois, Washington, New Jersey and North Carolina (to July 29) remained, with the price-gouging orders of Minnesota, California (to Sept. 4) and the statutory regimes; in 2020 Q4 Kentucky (to Oct. 20), Pennsylvania (to Nov. 9, then protected classes), New York, Washington, New Jersey and Arkansas continued, with winter moratoria taking over in Illinois, Pennsylvania and Connecticut; in 2021 Q1 and Q2 New York, Washington, New Jersey, Pennsylvania's protected-customer rules (to Mar. 31) and Minnesota's price-gouging order continued; in 2021 Q3 New York's Public Service Law 32(7) protection, Washington's Proclamation 20-23.16 (to Sept. 30, 2021), New Jersey's grace period, New York's ERAP stay and the District of Columbia's phased utility and eviction moratorium (D.C. Preemption. Not applicable to this cluster in the ordinary sense. Public utility commissions hold exclusive jurisdiction over the rates and service of the utilities they regulate (e.g., KRS 278.040(2), recited in Ex. 001), so their moratoria displaced inconsistent tariff terms and municipal-utility practice only where the commission's jurisdiction reached (Kentucky's order expressly noted that its jurisdiction 'does not extend' to municipal utilities and urged them to follow suit, Ex. 001 n.1). Price-gouging orders by governors were statewide and bound every seller in the State (Ex. 031, 032, 033, 034).
