The St. Louis metropolitan area ran on two State regimes and a dense local layer. On the Missouri side the State's own restrictions were short (the DHSS social-distancing order of March 21, 2020, the Stay Home Missouri order of April 3, 2020 effective April 6 through May 3, 2020, and the Phase 1 reopening order of April 27, 2020 effective May 4 through June 15, 2020; nothing statewide after June 16, 2020), so the City of St. Louis and St. Louis County orders were the operative limits on commerce, travel and group meetings for the metro's Missouri core from March 13, 2020 through May 13-14, 2021, and again from July 26, 2021. On the Illinois side the Governor's statewide orders governed the Metro East continuously (stay-at-home March 21-May 29, 2020; Phases 3 and 4; Tier 3 November 20, 2020; the Bridge Phase May 14, 2021; Phase 5 June 11, 2021; the indoor mask mandate from August 30, 2021), and the Metro East carried the State's first and longest regional resurgence mitigations (Region 4 Tier 1 from August 18, 2020 and Tier 2 from September 2, 2020, into Tier 3, then Tier 2 on January 22, 2021 and Phase 4 on February 4, 2021). 2020 Q2 and the March 13-31 run-up: the City proclaimed a public health emergency March 13, 2020 and forbade assemblies over 1,000 (Ex. MET-STL-001, -002); the County declared a state of emergency the same day (Ex. MET-STL-048); both capped gatherings at 50 by March 16 and at 10 by March 18-20 (Ex. MET-STL-003, -005, -049, -052); both closed restaurants and bars to dine-in service from March 19, 2020 (Ex. MET-STL-004, -046, -051); and both issued stay-at-home orders effective March 23, 2020 (City Order No. 5, 6:00 p.m.; County Stay at Home Order, 12:01 a.m.) closing every non-essential business and confining the customer base and workforce to home (Ex. MET-STL-006, -044, -057). The County's Executive Order 15 (March 21) and Executive Order 17 (April 22) made the DPH orders open-ended (Ex. MET-STL-053, -081); the County extended its stay-at-home order 'until it is rescinded' on April 20, 2020 (Ex. MET-STL-077) and the City replaced its order with Order No. 7 on April 16, 2020 (Ex. MET-STL-008). St. Charles County declared an emergency March 13 and on March 23, 2020 ordered residents to remain at their residences from 12:01 a.m. March 24 without an essential-business list, then deferred to the stricter statewide orders and announced on June 15, 2020 that it would follow Phase 2 with no restrictions from June 16 (Ex. MET-STL-026, -027, -029, -030). Metro Transit cut MetroLink to a weekend schedule and MetroBus to Saturday schedules from March 23, 2020, waived fares and boarded by rear door from March 21, urged essential trips only, and made face coverings mandatory on every vehicle from May 11, 2020 (Ex. MET-STL-038 to -042). The City and County reopened on May 18, 2020 under conditioned orders (City Order No. 8 with the Phase I Standards; County Business and Individual Guidelines) that kept gatherings at 10, required employee masks and daily screening, enforced the State's retail occupancy limits, and kept gyms, banquet rooms, bars without full meals, pools and sporting events closed (Ex. MET-STL-009, -024, -078); the County staged gyms, pools and leagues to June 15, 2020 (Ex. MET-STL-079, -071). 2020 Q3: universal face coverings from July 3, 2020 (City Order No. 11; County order of July 2) (Ex. MET-STL-012, -058, -102); the County's Second Amended (June 26), Third Amended (July 29) and face-covering amendments (Aug. 21) (Ex. MET-STL-108, -061, -060); youth sports limited to practice with no games or spectators from July 20, 2020 (Ex. MET-STL-070); the City's resurgence orders holding large venues at 75 percent (July 18) and then cutting bars, restaurants, nightclubs and large venues to 50 percent with an 11:00 p.m. closing from August 13, 2020, extended September 8 until rescinded (Ex. MET-STL-062); the winter re-tightening of November 12-18, 2020: the County's Safer At Home Order effective November 17 (residents to stay at their residences except specified purposes; gatherings of more than 10 prohibited; all public-facing businesses at 25 percent; restaurants barred from all indoor service; bars carryout only; businesses ordered to deny entry to the unmasked) (Ex. MET-STL-064, -104), moved to 50 percent on February 10 (Ex. MET-STL-105) and, by the Fourth Amended Order of March 8, 2021, kept the stay-at-residence rule, 50 percent caps, 25 percent for banquet facilities, gatherings of 20 indoors and 30 outdoors and a midnight curfew (Ex. MET-STL-075); the City moved its bars and restaurants to a midnight close on March 8, 2021 (Ex. MET-STL-017); the Metro East left Tier 3 on January 22 and reached Phase 4 on February 4, 2021 (indoor dining for parties of 10, 50 percent capacity) (Ex. MET-STL-036, -037). 2021 Q2: the County's Fifth Amended Order of April 8 (Ex. MET-STL-106); the City's Order No. 17 effective May 3, 2021 ended percentage caps but kept masks, distancing, screening and a 3:00 a.m. bar close (Ex. MET-STL-018); the County's Reopen STL Order of May 3, 2021 ended percentage caps but kept distancing and masks (Ex. MET-STL-068, -096); the County rescinded that order May 13, 2021 and the City rescinded Orders 1-17 on May 14, 2021 at 11:30 a.m. (Ex. MET-STL-107, -098, -019), leaving in force the County's Sixth Amended Quarantine and Isolation Order, Residential Living Facilities reporting order, non-congregate sheltering order and Rapid Notification Order, the emergency declarations, and the federal transit mask rule applied by Metro Transit (Ex. MET-STL-067, -056, -083, -043); Illinois reached the Bridge Phase May 14 and Phase 5 June 11, 2021. 2021 Q3: the Delta wave brought the metro back under orders. The City proclaimed a new public health emergency July 23, 2021 and imposed an indoor and public-transportation mask requirement on everyone age 5 and older, vaccinated or not, from 12:01 a.m. July 26, 2021, continued by Order No. 2 (signed August 30, 2021, effective on Board of Aldermen approval) and Order No. 3 (October 1, 2021) (Ex. MET-STL-020 to -023); the County imposed the same requirement from 8:00 a.m. July 26, 2021 (Ex. MET-STL-069, -090). The Attorney General sued both the same day (State ex rel. Schmitt v. Page, No. 21SL-CC03334, St. Louis County Circuit Court), the County Council voted 5-2 on July 27 to terminate the County order under RSMo § 67.265 (HB 271, effective June 15, 2021, Ex. MET-STL-025), and the Circuit Court enjoined the County's enforcement by TRO on August 3 and preliminary injunction on August 20, 2021; the City's order was never enjoined (Ex. MET-STL-091 to -093). Throughout the quarter the County's quarantine and isolation, residential-facility and rapid-notification orders and both emergency declarations stayed in force; Metro Transit required masks on every vehicle, platform and transit center under the TSA directive; and in the Metro East the Illinois indoor mask mandate took effect August 30, 2021, with the State's school-mask and health-care-worker vaccination orders (State file). St. Charles County issued no mask order at any time and no business order after March 2020, and is covered by the statewide orders, its own March 2020 stay-at-residence order, its April 2020 health-facility and reporting orders, and the City, County, Metro Transit and federal instruments reaching its commuting workforce and customers.

The State and the local orders

Missouri did not preempt local orders during 2020 or the first half of 2021: the Governor's June 2020 statement that 'no statewide order would follow' left the City and County orders as the operative limits, and the State's April 2020 orders expressly permitted stricter local rules. HB 271 (RSMo § 67.265), approved and effective June 15, 2021 (Ex. MET-STL-025), did not bar local orders; it limited an order that closes, partially closes or restricts access to businesses, churches, schools or places of assembly during a chapter 44 emergency to 30 days in any 180-day period unless extended by a simple majority of the governing body (21 days and a two-thirds vote absent an emergency) and empowered the governing body to terminate such an order by simple majority. The St. Louis County Council invoked it on July 27, 2021 (5-2) against the County's July 26, 2021 Face Covering Order; in State ex rel. Schmitt v. Page, No. 21SL-CC03334 (St. Louis County Cir. Ct.), Judge Ellen Ribaudo entered a TRO on Aug. 3, 2021 and a preliminary injunction on Aug. 20, 2021 barring the County from enforcing the order, holding the State likely to prevail on the Council's power to terminate it; the City of St. Louis was a defendant but its order was not enjoined, and the City conformed its later orders (Nos. 2 and 3 of 2021) to the statute by making them effective on Board of Aldermen approval for 30-day terms (Ex. MET-STL-022, -023, -091 to -093). Post-period: on Nov. 22, 2021 the Cole County Circuit Court (Green, J.) in Robinson v. DHSS declared the DHSS regulations (19 CSR 20-20.040 and 20-20.050) that delegated order-making power to local health directors unconstitutional and existing orders issued unilaterally by local health authorities 'null and void'; the Attorney General declined to appeal; St. Louis County rescinded its mask rule Dec. 9, 2021 (Ex. MET-STL-095). That judgment postdates the six claimable quarters; Illinois did not preempt local orders (the Governor's orders permitted stricter local rules); the Metro East counties issued no separate closure or mask orders and applied the State's regional and statewide instruments.
