Cluster ST-LABOR-WORKPLACE: State labor, workplace-safety and unemployment agencies as appropriate governmental authorities whose COVID-19 instruments limited commerce and group meetings at the workplace and governed the availability of the workforce. Summary

State labor and workplace-safety agencies were appropriate governmental authorities in the plain sense of the Suspension Clause: each held statutory power to prescribe binding conditions on the operation of every workplace within its jurisdiction, each exercised that power because of COVID-19, and each instrument limited commerce at the place of business (who could enter, how many, at what distance, wearing what, after what screening, with which workers excluded) and limited group meetings in terms. The cluster proves five things. First, the State-plan OSHA agencies converted the Governors' public-health orders into occupational-safety law enforceable by citation against every employer: Washington L&I's WAC 296-800-14035 (adopted May 26, 2020 and readopted without gap through Sept. 20, 2021, Exs. 050-056, 078, WA-067, WA-099) made every business prohibition and every operating condition in Proclamation 20-25 and its seventeen amendments a violation of chapter 49.17 RCW; Nevada OSHA published mandatory measures under Directives 013, 018, 021, 024, 035, 044, 045 and 047 and enforced them by unannounced observation, follow-up and citation (Exs. 028-041, NV-060); Oregon OSHA enforced the Oregon Health Authority's masking rules under ORS 654.025(3)(a) (Ex. 021). Second, five States wrote their own workplace standards with force of law and kept them in force through the end of the period: Virginia's 16VAC25-220 from July 27, 2020 to Mar. 23, 2022 (Exs. 001, 043, VA-036 to VA-038); Michigan's MIOSHA emergency rules from Oct. 14, 2020, extended Apr. 13 and amended May 24, 2021 (Exs. 062-065, MI-054); Oregon's OAR 437-001-0744 from Nov. 16, 2020, permanent May 4, 2021, amended June 30, Aug. 13 and Sept. 16, 2021 and repealed only in 2023 (Exs. 016-025, OR-032, OR-041, OR-044, OR-049); California's ETS from Nov. 30, 2020, readopted June 17, 2021 and expired Feb. 3, 2023 (Exs. 002, CA-023, CA-024); New Mexico's four-hour reporting rule from Aug. 5, 2020, permanent Jan. 26, 2021 (Exs. 027, 066-070); and Washington's HELSA rules from Aug. 10, 2021 (Exs. 008, 061, 080). Third, State legislatures and labor departments imposed paid-leave and job-protection mandates that removed quarantined, exposed, ill and caregiving employees from the workforce with pay in every industry: New York Ch. 25 (Mar. 18, 2020, Ex. 003); New Jersey c. 9 and c. 17 (Mar. 20 and 25, 2020, Exs. 005, 006); Colorado HELP Rules (Mar. 11, 2020) and the HFWA (July 14, 2020) with its 80-hour public health emergency leave (Exs. 004, 044-046); California EO N-51-20, AB 1867, SB 1159 and SB 95 (Exs. 007, 013, 014, CA-061), the last in force through Sept. 30, 2021; Massachusetts Ch. 16 and Ch. 55 (June 7, 2021 to Apr. 1, 2022, Exs. 009, 042); Michigan's PA 238 (Ex. MI-057). Fourth, the New York HERO Act required every private employer in the State to adopt an airborne infectious disease exposure prevention plan by Aug. 5, 2021 and to activate it Sept. 6, 2021 (Exs. 011, NY-082, NY-127 to NY-136): a Q3 2021 instrument of the largest labor department in the country, in force on Sept. 30, 2021. By quarter: 2020 Q2 opened with the Colorado HELP Rules, New York Ch. 25, New Jersey c. 9 and c. 17 and Nevada OSHA's essential-business memoranda in force, and closed with Oregon OSHA's agricultural rule (May 11), Washington's temporary worker housing rule (May 18) and WAC 296-800-14035 (May 26), Minnesota's preparedness-plan orders, Massachusetts' workplace standards, Pennsylvania's worker-safety order and Nevada's Directive 024 face-covering guidance added. 2020 Q3 added Virginia's ETS (July 27), Colorado's HFWA (July 15), New Mexico's reporting rule (Aug. 5), Nevada SB 4 and NAC 447E (Aug. 11 and 31), California AB 1867 and SB 1159 (Sept. 9 and 17) and Michigan's EO 2020-161 to 2020-184 workplace safeguards (struck down Oct. 2). 2020 Q4 added MIOSHA's emergency rules (Oct. 14), PA 238 (Oct. 22), New Jersey EO 192 (Nov. 5), Oregon's all-workplace rule (Nov. 16), Nevada's Statewide Pause measures (Nov. 24), Cal/OSHA's ETS (Nov. 30) and New Mexico's second emergency amendment (Dec. 3). 2021 Q1 added Colorado's Wage Protection Rules (Jan. 1), California AB 685 (Jan. 1), Virginia's permanent standard (Jan. 27), New Mexico's permanent rule (Jan. 26) and California SB 95 (Mar. 29). 2021 Q2 added Oregon's permanent rule (May 4), Washington HELSA (May 11), the Michigan amendments (May 24) and rescission (June 22), New York's HERO Act (June 4), New Jersey EO 243 (June 4), Massachusetts Ch. 16 (June 7) and Cal/OSHA's readoption (June 17). No single instrument: the State workplace standards outlived every Governor's general business restriction. Virginia's standard was revoked Mar. 23, 2022 (Ex. 043); Oregon's all-workplace rule lost its indoor masking Mar. 18, 2022 (Ex. 025) and was suspended Apr. 3, 2023 (Ex. 023); California's ETS expired Feb. 3, 2023; Washington's WAC 296-800-14035 fell with the proclamations Oct. 31, 2022; MIOSHA's rules were rescinded June 22, 2021; Nevada OSHA was still enforcing the Governor's directives on Dec. 27, 2021 (Ex. 041).

Preemption. Not applicable in the ordinary sense: these are State-level agencies. Two relationships matter. (a) Federal-State: each of Virginia, Michigan, Oregon, California, Washington, Nevada, New Mexico and Minnesota operates an OSHA-approved State plan under 29 U.S.C. § 667 and 29 C.F.R. Part 1952 and must be 'at least as effective as' federal OSHA; their COVID-19 standards therefore bound private employers in place of federal OSHA and, from July 2021, incorporated the federal Healthcare ETS (Exs. 021, 040). (b) State-local: the standards applied uniformly statewide and did not displace county and city health orders, which the State-plan agencies enforced alongside (Washington's rule expressly incorporated the Governor's proclamations 'including proclamation amendments and conditions'; Oregon OSHA enforced OHA's masking rules under ORS 654.025(3)(a)).
